the consumer. A consumer’s affiliate
marketing opt-out election must be
effective for a period of at least five
years. Upon expiration of the opt-out
period, the consumer must be given a
renewal notice and an opportunity to
renew the opt-out before information
received from an affiliate may be used
to make solicitations to the consumer.
Comments: The OCC issued a notice
in the Federal Register for 60 days of
comment on September 13, 2013 (78 FR
56771). No comments were received.

performance of the functions of the
OCC, including whether the information
has practical utility;
(b) The accuracy of the OCC’s
estimate of the information collection
burden;
(c) Ways to enhance the quality,
utility, and clarity of the information to

(d) Ways to minimize the burden of
the collection on respondents, including
through the use of automated collection
techniques or other forms of information
technology; and
(e) Estimates of capital or start-up
costs and costs of operation,
maintenance, and purchase of services
to provide information.

Abstract: This is a new form
established under Section 9010 of the
Patient Protection and Affordable Care
Act (PPACA), Public Law 111–148 (124
Stat. 119 (2010)), as amended by section
10905 of PPACA, and as further
amended by section 1406 of the Health
Care and Education Reconciliation Act
of 2010, Public Law 111–152 (124 Stat.
1029 (2010)), which requires any
covered entity engaged in the business
of providing health insurance related to
United States health risks to annually
report its net premiums written.
Current Actions: This is a new form.
This form is being submitted for OMB
approval.
