I. Statutory/Legal Authority for This
Rulemaking
This ANPRM is published under the
authority of 49 U.S.C. 5103(b), which
authorizes the Secretary of
Transportation to ‘‘prescribe regulations
for the safe transportation, including
security, of hazardous materials in
intrastate, interstate, and foreign
commerce.’’ The petitions and
recommendations addressed in the
ANPRM purport to address safety issues
with the transportation of hazardous
materials in commerce. Our goal in this
ANPRM is to gather the necessary
information to determine a course of
action in a potential Notice of Proposed
Rulemaking (NPRM).
