The Peace Corps is correcting
a typographical error in a proposed rule
that appeared in the Federal Register of
August 7, 2013. The proposed rule
updates Peace Corps regulations on the
Freedom of Information Act (FOIA) to
implement guidance given by the
President and the Attorney General
regarding discretionary disclosures of
records or information exempt from
disclosure under the FOIA, whenever
disclosure would not foreseeably harm
an interest protected by a FOIA
exemption. The proposed rule is based
on language used by Department of
Justice in its FOIA regulations.
Additionally, the proposed rule deletes
unnecessary and superfluous language
and ensures the rule is consistent with
current law.

The Bureau of Indian Affairs
is proposing to revise the regulations
addressing oil and gas mining on
reservation land of the Osage Nation.
This rule updates the leasing procedures
and rental, production, and royalties
requirements for oil and gas on Osage
Mineral lands and is the result of a
negotiated rulemaking.
DATES: Comments on this proposed rule
must be received by October 28, 2013.
Comments on the information
collections contained in this proposed
regulation are separate from those on
the substance of the rule. Comments on
the information collection burden
should be received by September 27,
2013 to ensure consideration, but must
be received no later than October 28,
2013.

SUPPLEMENTARY INFORMATION:
I. Executive Summary of Rule
This rule updates the oil and gas
regulations governing Osage County. It
is intended to strengthen the
management and administration of the
Osage mineral estate for the benefit of
the Osage. These provisions provide
updated reporting and inspection
requirements, further specify lessee
obligations with respect to operations,
revise royalty rate calculations and
update the amounts for bonds, fines and
penalties.
II. Background
On October 14, 2011, the United
States and the Osage Nation (formerly
known as the Osage Tribe) signed a
Settlement Agreement to resolve
litigation regarding alleged
mismanagement of the Osage Nation’s
oil and gas mineral estate, among other
claims. In the Settlement Agreement,
the parties agreed that it would be
mutually beneficial ‘‘to address means
of improving the trust management of
the Osage Mineral Estate, the Osage
Tribal Trust Account, and Other Osage
Accounts.’’ The parties agreed that a
review and revision of the existing
regulations is warranted to better assist
the Bureau of Indian Affairs (BIA) in
managing the Osage Mineral Estate. The
parties agreed to engage in a negotiated
rulemaking for this purpose. For
additional information on the negotiated

Committee submitted its report to BIA
on April 25, 2013. BIA has based this
proposed rule on the report.
III. Detailed Explanation of Revisions
This rule revises 25 CFR part 226 by
changing all references to the ‘‘Osage
Tribal Council’’ to the ‘‘Osage Minerals
Council’’ because the Osage Tribal
Council no longer exists and the Osage
Minerals Council has the authority to
make decisions regarding the Osage
minerals estate. To avoid confusion in
terminology, this rule changes all
