Notice Pursuant to the National
Cooperative Research and Production
Act of 1993—National Warheads and
Energetics Consortium
Notice is hereby given that, on July
22, 2013, pursuant to Section 6(a) of the
National Cooperative Research and
Production Act of 1993, 15 U.S.C. 4301
et seq. (‘‘the Act’’), National Warheads
and Energetics Consortium (‘‘NWEC’’)
has filed written notifications
simultaneously with the Attorney
General and the Federal Trade
Commission disclosing changes in its
membership. The notifications were
filed for the purpose of extending the
Act’s provisions limiting the recovery of
antitrust plaintiffs to actual damages
under specified circumstances.

the Department on February 19, 2013. A
notice was published in the Federal
Register pursuant to Section 6(b) of the

Kevin Dennis, M.D., Decision and
Order
On April 12, 2011, the Deputy
Assistant Administrator, Office of
Diversion Control, issued an Order to
Show Cause to Kevin Dennis, M.D.
(hereinafter, Respondent), of Franklin,
Tennessee. The Show Cause Order
proposed the revocation of
Respondent’s DEA Certification of
Registration and the denial of his
application to renew his registration on
the ground that his ‘‘continued
registration is inconsistent with the
public interest.’’ ALJ Ex. 1, at 1 (citing
21 U.S.C. 823(f)).
More specifically, the Show Cause
Order alleged that from September 2007
through July 2009, Respondent
‘‘prescribed controlled substances to
individuals located in Colorado,
Mississippi, North Carolina, South
Carolina and Tennessee via the Internet
based on online questionnaires,
submissions of unverified medical
records, and/or telephone consultations
without a medical examination.’’ Id.
The Show Cause Order alleged that
Respondent ‘‘failed to establish a valid
physician-patient relationship’’ as
required by various state laws and that
