For the reasons set out in this
document, 40 CFR part 300 is amended
as follows:
The implemented remedy achieves
the degree of cleanup specified in the
ROD and ROD Amendment for all
pathways of exposure. All selected
remedial action objectives and clean-up
goals are consistent with agency policy
and guidance. No further Superfund
responses are needed to protect human
health and the environment at the Site.
The NCP (40 CFR 300.425(e)) states
that a site may be deleted from the NPL
when no further response action is
appropriate. EPA, in consultation with
the State of California, has determined
that all required response actions have
been implemented, and no further
response action by the responsible
parties is appropriate.

Rate Regulation Reforms
ACTION:

The EPA, with concurrence of the
State of California through the
California Regional Water Quality
Control Board—San Francisco Bay
Region, has determined that all
appropriate response actions under
CERCLA have been completed.
Therefore, EPA is deleting the Site from
the NPL.
Because EPA considers this action to
be noncontroversial and routine, EPA is
taking it without prior publication. This
action will be effective September 23,
2013 unless EPA receives adverse
comments by August 23, 2013. If
adverse comments are received within
the 30-day public comment period, EPA
will publish a timely withdrawal of this
direct final notice of deletion before the
effective date of the deletion, and it will
not take effect. EPA will prepare a
response to comments and continue
with the deletion process on the basis of
the notice of intent to delete and the
comments already received. There will
be no additional opportunity to
comment.

Determination That the Site Meets the
Criteria for Deletion in the NCP

The Surface Transportation
Board (Board) changes some of its
existing regulations and procedures
concerning rate complaint proceedings.
The Board previously created two
simplified procedures to reduce the
time, complexity, and expense of rate
cases. The Board now modifies its rules
to remove the limitation on relief for
one simplified approach, and to raise
the relief available under the other
simplified approach. The Board also
makes technical changes to the full and
simplified rate procedures; changes the
interest rate that railroads must pay on
reparations if they are found to have
charged unreasonable rates; and
announces future proceedings on
options for addressing cross-over traffic
and on proposals to address the
concerns of small agricultural shippers.
The purpose of these actions is to
ensure that the Board’s simplified and
expedited processes for resolving rate
disputes are more accessible.

August 17, 2013.
