proposed rule would not have
disproportionately high and adverse
human health or environmental effects
on minority or low-income populations
because it merely would correct
provisions for manufacturers to use to
demonstrate compliance of heavy-duty

V. Statutory Authority
Statutory authority for the vehicle
controls is found in Clean Air Act
section 202(a) (which authorizes
standards for emissions of pollutants
from new motor vehicles which
emissions cause or contribute to air
pollution which may reasonably be
anticipated to endanger public health or
welfare), sections 202(d), 203–209, 216,
and 301 (42 U.S.C. 7521(a), 7521(d),
7522, 7523, 7524, 7525, 7541, 7542,
7543, 7550, and 7601).
