The term ‘‘designated representative’’ means Coast Guard Patrol Commanders, including Coast Guard coxswains, petty officers, and other officers operating Coast Guard vessels, and Federal, state, and local officers designated by or assisting the Captain of the Port Jacksonville in the enforcement of the regulated areas. (c) Regulations. (1) All persons and vessels are prohibited from: (i) Entering, transiting through, anchoring in, or remaining within the race area unless participating in the race. (ii) Entering, transiting through, anchoring in, or remaining within the buffer zone, unless enforcing the buffer zone or an authorized race participant transiting to or from the race area. (2) Persons and vessels desiring to enter, transit through, anchor in, or remain within the regulated areas may contact the Captain of the Port Jacksonville by telephone at (904) 564– 7513, or a designated representative via VHF radio on channel 16, to request authorization. If authorization is granted by the Captain of the Port Jacksonville or a designated representative, all persons and vessels receiving such authorization must comply with the instructions of the Captain of the Port Jacksonville or a designated representative. (3) The Coast Guard will provide notice of the regulated areas to the public by Local Notice to Mariners, Broadcast Notice to Mariners, and onscene designated representatives. (d) Enforcement Period. Regulatory History and Information The Coast Guard is issuing this temporary final rule without prior notice and opportunity to comment pursuant to authority under section 4(a) of the Administrative Procedure Act (APA) (5 U.S.C. 553(b)). This provision authorizes an agency to issue a rule without prior notice and opportunity to comment when the agency for good cause finds that those procedures are ‘‘impracticable, unnecessary, or contrary to the public interest.’’ Under 5 U.S.C. 553(b)(B), the Coast Guard finds that good cause exists for not publishing a notice of proposed rulemaking (NPRM) with respect to this rule because doing PO 00000 Frm 00031 Fmt 4700 Sfmt 4700 so would be impracticable and contrary to the public interest. The final details for this event were not known to the Coast Guard until there was insufficient time remaining before the event to publish an NPRM. Thus, delaying the effective date of this rule to wait for a comment period to run would be both impracticable and contrary to the public interest because it would inhibit the Coast Guard’s ability to protect participants, spectators, and vessels from the hazards associated with a large scale swimming event, which are discussed further below. Under 5 U.S.C. 553(d)(3), The Coast Guard finds that good cause exists for making this temporary rule effective less than 30 days after publication in the Federal Register. For the same reasons discussed in the preceding paragraph, waiting for a 30 day notice period to run would be impracticable and contrary to the public interest. B. Basis and Purpose The legal basis for the rule is the Coast Guard’s authority to establish regulated navigation areas and limited access areas: 33 U.S.C. 1231; 46 U.S.C. Chapter 701, 3306, 3703; 50 U.S.C. 191, 195; 33 CFR 1.05–1, 6.04–1, 6.04–6, 160.5; Public Law 107–295, 116 Stat. 2064; Department of Homeland Security Delegation No. 0170.1. Between 9:00 a.m. and 11:00 a.m. on June 22, 2013, a large scale swimming event will be held on Presque Isle Bay near the Erie Yacht Club lighthouse dock, Erie, PA. The Captain of the Port Buffalo has determined that this large scale swimming event across a navigable waterway will pose significant risks to participants and the boating public. C. Discussion of the Final Rule With the aforementioned hazards in mind, the Captain of the Port Buffalo has determined that this temporary safety zone is necessary to ensure the safety of participants, spectators, and vessels during the Bay Swim VI swimming event.     Under the provisions of 33 CFR 100.100 & 33 CFR 165.151, The 
fireworks displays, and regatta event listed above are established as 
safety zones or special local regulation. During these enforcement 
periods, persons and vessels are prohibited from entering into, 
transiting through, mooring, or anchoring within the safety zones or 
special local regulation unless they receive permission from the COTP 
or designated representative.
    This notice is issued under authority of 33 CFR 100, 33 CFR 165 and 
5 U.S.C. 552(a). In addition to this notice in the Federal Register, 
the Coast Guard will provide the maritime community with advance 
notification of this enforcement period via the Local Notice to 
Mariners or marine information broadcasts. If the COTP determines that 
a regulated area need not be enforced for the full duration stated in 
this notice, a Broadcast Notice to Mariners may be used to grant 
general permission to enter the regulated area.
