Executive Orders 12866 and 13563
direct agencies to assess the costs and
benefits of available regulatory
alternatives and, when regulation is
necessary, to select regulatory
approaches that maximize net benefits
(including potential economic,
environmental, public health and safety
effects, and other advantages;
distributive impacts; and equity).
Executive Order 13563 (Improving
Regulation and Regulatory Review)
emphasizes the importance of
quantifying both costs and benefits,
reducing costs, harmonizing rules, and
promoting flexibility. Executive Order
12866 (Regulatory Planning and
Review) defines a ‘‘significant
regulatory action,’’ which requires
review by the Office of Management and
Budget (OMB), as ‘‘any regulatory action
that is likely to result in a rule that may:
(1) Have an annual effect on the
economy of $100 million or more or
adversely affect in a material way the
economy, a sector of the economy,
productivity, competition, jobs, the
environment, public health or safety, or
State, local, or tribal governments or
communities; (2) Create a serious
inconsistency or otherwise interfere
with an action taken or planned by
another agency; (3) Materially alter the
budgetary impact of entitlements,
grants, user fees, or loan programs or the
rights and obligations of recipients
thereof; or (4) Raise novel legal or policy
issues arising out of legal mandates, the
President’s priorities, or the principles
set forth in this Executive Order.’’

Unfunded Mandates
The Unfunded Mandates Reform Act
of 1995 requires, at 2 U.S.C. 1532, that
agencies prepare an assessment of
anticipated costs and benefits before
issuing any rule that may result in an
expenditure by State, local, and tribal
governments, in the aggregate, or by the
private sector, of $100 million or more
(adjusted annually for inflation) in any
given year. This final rule will have no
such effect on State, local, and tribal
governments, or on the private sector.
Regulatory Flexibility Act
The Secretary hereby certifies that
this final rule will not have a significant
economic impact on a substantial
number of small entities as they are
defined in the Regulatory Flexibility
Act, 5 U.S.C. 601–612. This final rule
will temporarily freeze the copayments
that certain veterans are required to pay
for prescription drugs furnished by VA.
This final rule affects individuals and
has no impact on small entities.
Therefore, pursuant to 5 U.S.C. 605(b),
this rulemaking is exempt from the
initial and final regulatory flexibility
analysis requirements of sections 603
and 604.

Management District (SCAQMD) portion

Plan (SIP). This action was proposed in
the Federal Register on February 4,
2013 and concerns volatile organic
compound (VOC) emissions from
municipal solid waste landfills and
dairies. We are approving local rules
that regulate these emission sources
under the Clean Air Act (CAA or the
Act).

June 24, 2013.

submissions, EPA’s role is to approve
State choices, provided that they meet
the criteria of the Clean Air Act.
Accordingly, this action merely
approves State law as meeting Federal
requirements and does not impose
additional requirements beyond those
imposed by State law. For that reason,
this action:

SUMMARY: EPA is approving a revision to
the Illinois state implementation plan
(SIP) to reflect current National Ambient
Air Quality Standards (NAAQS) for
ozone and particulate matter (PM). EPA
is approving a revision to add new
incorporations by reference associated
with current ozone, lead, and
particulate matter NAAQS into the
Illinois SIP. EPA is also approving
revisions that amend typographical
errors in the Illinois SIP.
DATES: This direct final rule will be
effective July 22, 2013, unless EPA
receives adverse comments by June 24,
2013. If adverse comments are received,
EPA will publish a timely withdrawal of
the direct final rule in the Federal
Register informing the public that the
rule will not take effect.

Today’s action updates the Illinois
SIP to reflect current ozone and PM
NAAQS promulgated by EPA. On July
18, 1997 (62 FR 38856), EPA published
a final rule that established NAAQS for
ozone measured as a daily maximum
eight hour concentration of 0.08 parts
per million (ppm), based on the three
year average of the fourth highest daily
eight hour value recorded during each
calendar year. The eight hour NAAQS
replaced the one hour ozone NAAQS,
however, the one hour ozone
designations and classifications were
retained to comply with antibacksliding obligations. On April 30,
2004 (69 FR 23951), EPA published the
first phase of its final rule to implement
the eight hour ozone NAAQS and
revoke the one hour ozone NAAQS. At
the same time, EPA also published eight
hour ozone designations for all areas of
the country (69 FR 23858, April 30,
2004). On August 3, 2005 (70 FR 44470),
EPA published a final rule that revoked
the one hour ozone NAAQS. On July 11,
2007 (72 FR 37818), EPA proposed to
strengthen the NAAQS for ozone by
revising the level of the eight hour
standard to a level within the range of
0.070 to 0.075 ppm daily maximum
eight hour concentration, based on the
three year average of fourth highest
daily eight hour value recorded during

the rule must submit a rule report, which includes a copy of the rule,
to each House of the Congress and to the Comptroller General of the
United States. EPA will submit a report containing this action and
other required information to the U.S. Senate, the U.S. House of
Representatives, and the Comptroller General of the United States prior
to publication of the rule in the Federal Register. A major rule cannot
take effect until 60 days after it is published in the Federal
Register. This action is not a ``major rule'' as defined by 5 U.S.C.
804(2).
Under section 307(b)(1) of the Clean Air Act, petitions for
judicial review of this action must be filed in the United States Court
of Appeals for the appropriate circuit by July 22, 2013. Filing a
petition for reconsideration by the Administrator of this final rule
does not affect the finality of this action for the purposes of
judicial review nor does it extend the time within which a petition for
judicial review may be filed, and shall not postpone the effectiveness
of such rule or action. This action may not be challenged later in
proceedings to enforce its requirements (see section 307(b)(2)).
