AGENCY:
SUMMARY: The Department of
Transportation (DOT) invites public
comments about our intention to request
the Office of Management and Budget
(OMB) approval for a new information
collection. The collection involves
labeling requirements for manufacturers
and packagers of brake fluids as well as
packagers of hydraulic system mineral
oils. The information to be collected
will be used to and/or is necessary to
insure the following: the contents of the
container are clearly stated; these fluids
are used for their intended purpose
only; and, the containers are properly
disposed of when empty. We are
required to publish this notice in the
Federal Register by the Paperwork
Reduction Act of 1995, Public Law 104–
13.

SUMMARY: This document grants in full
the BMW of North America, LLC (BMW)
petition for exemption of the X4 vehicle
line in accordance with 49 CFR part
543, Exemption from the Theft

granted because the agency has
determined that the antitheft device to
be placed on the line as standard
equipment is likely to be as effective in
reducing and deterring motor vehicle
theft as compliance with the partsmarking requirements of the Theft
Prevention Standard (49 CFR part 541).
BMW requested confidential treatment
for specific information in its petition
that the agency will address by separate
letter.
DATES: The exemption granted by this
notice is effective beginning with the
2015 model year (MY).

SUPPLEMENTARY INFORMATION: In a
petition dated January 25, 2013, BMW
requested an exemption from the partsmarking requirements of the Theft
Prevention Standard (49 CFR part 541)
for the X4 vehicle line beginning with
MY 2015. The petition requested
exemption from parts-marking pursuant
to 49 CFR part 543, Exemption from
Vehicle Theft Prevention Standard,
based on the installation of an antitheft
device as standard equipment for an
entire vehicle line.
Under § 543.5(a), a manufacturer may
petition NHTSA to grant an exemption
for one vehicle line per model year. In
its petition, BMW provided a detailed
description and diagram of the identity,
design, and location of the components
of the antitheft device for its X4 vehicle
line. BMW stated that all X4 vehicles
will be equipped with a passive
antitheft device as standard equipment
beginning with MY 2015. Key features
of the antitheft device will include a key
with a transponder, loop antenna (coil),
engine control unit (DME/DDE) with
encoded start release input, an
electronically coded vehicle
immobilizer/car access system (EWS/
CAS) control unit and a passive
immobilizer. BMW will not offer an
audible or visible alarm feature on the
proposed device. BMW’s submission is
considered a complete petition as
required by 49 CFR 543.7, in that it
meets the general requirements
contained in § 543.5 and the specific
content requirements of § 543.6.
BMW stated that the antitheft device
is a passive vehicle immobilizer system.
BMW further stated that the EWS
immobilizer device prevents the vehicle
