SUPPLEMENTARY INFORMATION: The
National Environmental Education Act
requires that the Council be comprised
of eleven (11) members appointed by
the Administrator of EPA. Members
represent a balance of perspectives,
professional qualifications, and
experience. The Act specifies that
members must represent the following
sectors: Primary and secondary
education (one of whom shall be a
classroom teacher)—two members;
colleges and universities—two
members; business and industry—two
members; non profit organizations
involved in environmental education—
two members; state departments of
education and natural resources—one
member each; senior Americans—one
member. Members are chosen to
represent various geographic regions of
the country, and the Council strives for
a diverse representation. The
professional backgrounds of Council
members should include education,
science, policy, or other appropriate
disciplines. Each member of the Council
shall hold office for a one (1) to three
(3) year period. Members are expected
to participate in up to two (2) meetings
per year and monthly or more
conference calls per year. Members of
the Council shall receive compensation
and allowances, including travel
expenses, at a rate fixed by the
Administrator.

SUMMARY: EPA issued a document in the
Federal Register of September 30, 2009
(74 FR 50187) (FRL–8437–7) concerning
the cancellations and amendments of
pesticide products containing organic
arsenicals. A portion of the voluntary
cancellation request giving rise to the
2009 document was conditioned upon
the convening of a public scientific peer
review process that would address the
mode of action for carcinogenic effects
of inorganic arsenic. Because the peer
review process has not yet occurred, the
cancellations of the sod farm, golf
course, and highway rights-of-way uses
identified in the 2009 document were
improperly finalized, and the existing
stocks provisions for all remaining
products containing the organic
arsenical monosodium methanearsonate
(MSMA) will be corrected as noted in
Unit II. of this document. In addition,
this document clarifies that existing
stocks of products already in the hands
of users as of December 31, 2010,
containing MSMA labeled for all uses,
except cotton, sod farms, golf courses,
and highway rights-of-way and products
containing disodium methanearsonate
(DSMA), calcium acid methanearsonate
(CAMA), and cacodylic acid and its
sodium salt, can be used legally until
they are exhausted, provided that such
use complies with the EPA-approved
label and labeling accompanying the
affected product.
