Fischer Living Trust, (‘‘Fischer Trust’’), under Section 107 of the Comprehensive Environmental Response, Compensation, and Liability Act (‘‘CERCLA’’), 42 U.S.C. 9607, related to releases and threatened releases of hazardous substances at the Puente Valley Operable Unit (‘‘PVOU’’) of the San Gabriel Valley Superfund Site, Area 4, Los Angeles County, California (the ‘‘Site’’). The Consent Decree recovers $410,000 in response costs from Defendant and provides a covenant not to sue to Defendant for past and certain future costs and response work at the Site under Sections 106 and 107 of CERCLA and Section 7003 of the Resource Conservation and Recovery Act, (‘‘RCRA’’), 42 U.S.C. 6973. The publication of this notice opens a period for public comment on the Consent Decree.
