Federal Register / Vol. 78, No. 37 / Monday, February 25, 2013 / Notices
under Section 7 of the ESA to address
these changes in the proposed action. A
new Biological Opinion was issued on
February 14, 2012. The Biological
Opinion determined that the issuance of
IHA is not likely to jeopardize the
continued existence of the Cook Inlet
beluga whales or the western DPS of
Steller sea lions, or destroy or adversely
modify Cook Inlet beluga whale critical
habitat. Finally, the Biological Opinion
includes an Incidental Take Statement
(ITS) for Cook Inlet beluga whales and
Steller sea lions. The ITS contains
reasonable and prudent measures
implemented by terms and conditions to
minimize the effects of this take.
National Environmental Policy Act
(NEPA)
NMFS prepared an Environmental
Assessment to determine whether this
proposed activity will have a significant
effect on the human environment. This
analysis was completed prior to the
issuance the IHA with NMFS’ issuance
of a Finding of No Significant Impact
(FONSI).
Authorization
NMFS has issued an incidental
harassment authorization for the take of
marine mammals incidental to Apache’s
seismic survey in Cook Inlet, Alaska,
provided the previously mentioned
mitigation, monitoring, and reporting
requirements are incorporated.
Dated: February 20, 2013.
Helen M. Golde,
Acting Director, Office of Protected Resources,
National Marine Fisheries Service.
