SUPPLEMENTARY INFORMATION: For
further information, please see the
direct final action, of the same title,
which is located in the Rules section of
this Federal Register. EPA is approving
the State’s SIP revision as a direct final
rule without prior proposal because
EPA views this as a noncontroversial
SIP revision and anticipates no adverse
comments. A detailed rationale for the
approval is set forth in the preamble to
the direct final rule. If EPA receives no
adverse comments, EPA will not take
further action on this proposed rule.
If EPA receives adverse comments,
EPA will withdraw the direct final rule
and it will not take effect. EPA will
address all public comments in a
subsequent final rule based on this
proposed rule. EPA will not institute a
second comment period on this action.
Any parties interested in commenting
on this action should do so at this time.
Please note that if we receive adverse
comment on an amendment, paragraph,
or section of this rule and if that
provision may be severed from the
remainder of the rule, EPA may adopt
as final those provisions of the rule that
are not the subject of an adverse
comment.

FOR FURTHER INFORMATION CONTACT:
The EPA is providing notice
that it has responded to petitions for
reconsideration of rules published in
the Federal Register on May 21, 2012,
and June 11, 2012, that together
promulgated the initial air quality
designations for the 2008 ozone national
ambient air quality standards for all
areas in the United States. The rules are
titled, ‘‘Air Quality Designations for the
2008 Ozone National Ambient Air
Quality Standards,’’ and ‘‘Air Quality
Designations for the 2008 Ozone
National Ambient Air Quality Standards
for Several Counties in Illinois, Indiana,
and Wisconsin; Corrections to
Inadvertent Errors in Prior
Designations.’’ Subsequent to
publishing the rules, during the time
period from June through October 2012,
the EPA received numerous petitions
requesting that the EPA reconsider its
designation decisions for certain areas.
The EPA carefully considered the
petitions and supporting information,
along with information contained in the
rulemaking docket, in reaching

decisions on the petitions. The EPA
denied all the petitions for
reconsideration in separate letters to the
petitioners dated December 14, 2012.
The letters explain the EPA’s reasons for
the denials. Four petitioners also
requested that the EPA stay the
effectiveness of the designation rule as
it applies for a particular area, pending
reconsideration. Because the EPA
denied the reconsideration requests, the
EPA also denied the stay requests.

Section 307(b)(1) of the Clean Air Act
indicates which Federal Courts of
Appeal have venue for petitions of
review of final actions by the EPA. This
section provides, in part, that petitions
for review must be filed in the Court of
Appeals for the District of Columbia
Circuit: (i) When the agency action
consists of ‘‘nationally applicable
regulations promulgated, or final actions
taken, by the Administrator,’’ or (ii)
when such action is locally or regionally
applicable, if ‘‘such action is based on
a determination of nationwide scope or

effect and if in taking such action the
Administrator finds and publishes that
such action is based on such a
determination.’’ In the rules establishing
air quality designations for the 2008
ozone national ambient air quality
standards, the EPA determined that the
actions are of nationwide scope and
effect for the purposes of section

2012 and 77 FR 34221; June 11, 2012.)
The EPA has determined that its
actions denying the petitions for
reconsideration also are of nationwide
scope and effect because these actions

effect. Thus, any petitions for review of

II. Judicial Review
Section 307(b)(1) of the Clean Air Act indicates which Federal
