NST, Inc. and Yuan Cheng International Group, Inc., Civil Action No. CV–12–1836. The United States filed this lawsuit under the Clean Air Act. The United States’ complaint seeks injunctive relief and civil penalties for the importation and sale of highway motorcycles, recreational vehicles, and engines in violation of certification and labeling requirements of the Clean Air Act and its regulations. The complaint also alleges violations of the Clean Air Act’s information collection requirements. The consent decree requires defendants and two executives of the companies to pay a civil penalty of $50,000 (which amount was based on an assessment of ability to pay) and, for a period of ten years, not to import vehicles and engines unless they have first entered into a compliance plan with the Environmental Protection Agency. The publication of this notice opens a period for public comment on the consent decree.
