On
October 13, 2005, the final Cross-Media
Electronic Reporting Rule (CROMERR)
was published in the Federal Register
(70 FR 59848) and codified as part 3 of
title 40 of the CFR. CROMERR
establishes electronic reporting as an
acceptable regulatory alternative to
paper reporting and establishes
requirements to assure that electronic
documents are as legally dependable as
their paper counterparts. Subpart D of
CROMERR requires that state, tribal or
local government agencies that receive,
or wish to begin receiving, electronic
reports under their EPA-authorized
programs must apply to EPA for a
revision or modification of those
programs and obtain EPA approval.
Subpart D provides standards for such
approvals based on consideration of the
electronic document receiving systems
that the state, tribe, or local government
will use to implement the electronic
reporting. Additionally, § 3.1000(b)
through (e) of 40 CFR part 3, subpart D
provides special procedures for program
revisions and modifications to allow
electronic reporting, to be used at the
option of the state, tribe or local
government in place of procedures
available under existing programspecific authorization regulations. An
application submitted under the subpart
D procedures must show that the state,
tribe or local government has sufficient
legal authority to implement the
electronic reporting components of the
programs covered by the application
and will use electronic document
receiving systems that meet the
applicable subpart D requirements.
On September 10, 2010, the Wyoming
Department of Environmental Quality
(WY DEQ) submitted an amended
application titled ‘‘Environmental
Information Technology Enterprise
System’’ for revisions/modifications of
its EPA-authorized programs under title
40 CFR. EPA reviewed WY DEQ’s
request to revise/modify its EPAauthorized programs and, based on this
review, EPA determined that the
application met the standards for
approval of authorized program
revisions/modifications set out in 40
CFR part 3, subpart D. In accordance
with 40 CFR 3.1000(d), this notice of
EPA’s decision to approve Wyoming’s
request to revise/modify its following
EPA-authorized programs to allow
electronic reporting under 40 CFR parts
51–52, 60–61, 63, 70, 72, 75, 258, 260,
262–265, 268, 270, and 280 is being
published in the Federal Register:

of Implementation Plans;
Part 61—National Emissions
Standards for Hazardous Air Pollutants;

As of October 1, 2012, EPA will not
accept paper copies or CDs of EISs for
filing purposes; all submissions on or
after October 1, 2012 must be made
through e-NEPA. While this system
eliminates the need to submit paper or
CD copies to EPA to meet filing
requirements, electronic submission
does not change requirements for
distribution of EISs for public review
and comment. To begin using e-NEPA,
you must first register with EPA’s

improvement in Federal Class I areas in
a multi-pollutant context.

SUPPLEMENTARY INFORMATION: The Clean
Air Act Amendments of 1990 contain at
Section 184 provisions for the Control of
Interstate Ozone Air Pollution. Section
184(a) establishes an Ozone Transport
Region (OTR) comprised of the States of
Connecticut, Delaware, Maine,
Maryland, Massachusetts, New
Hampshire, New Jersey, New York,
Pennsylvania, Rhode Island, Vermont,
parts of Virginia and the District of
Columbia. The purpose of the OTC is to
deal with ground-level ozone formation,
transport, and control within the OTR.
MANE–VU was formed in 2001, in
response to EPA’s issuance of the
Regional Haze rule. MANE–VU’s
members include: Connecticut,
Delaware, the District of Columbia,
Maine, Maryland, Massachusetts, New
Hampshire, New Jersey, New York,
Pennsylvania, Rhode Island, Vermont,
the Penobscot Indian Nation, the St.
Regis Mohawk Tribe along with EPA
and Federal Land Managers.
