A hearing, if requested, will be held
two days after the date the rebuttal
briefs are due. The Department will
issue a notice of final results of this full
sunset review, which will include the
results of its analysis of issues raised in
any such comments, no later than
February 26, 2012.9
Notification Regarding Administrative
Protective Order
This notice also serves as a
preliminary reminder to parties subject
to administrative protective order
(‘‘APO’’) of their responsibility
concerning the return or destruction of
proprietary information disclosed under
APO in accordance with 19 CFR
351.305. Timely notification of the
return or destruction of APO materials
or conversion to judicial protective
order is hereby requested. Failure to
comply with the regulations and terms
of an APO is a violation which is subject
to sanction.
We are issuing and publishing these
preliminary results and notice in
accordance with sections 751(c), 752,
and 777(i)(1) of the Act.

measures for the summer flounder,
scup, and black sea bass fisheries for the
2013 fishing year. Multi-year
recreational measures may be
considered for summer flounder and
scup.
Although non-emergency issues not
contained in this agenda may come
before this group for discussion, those
issues may not be the subject of formal
action during this meeting. Action will
be restricted to those issues specifically
listed in this notice and any issues
arising after publication of this notice
that require emergency action under
section 305(c) of the Magnuson-Stevens
Fishery Conservation and Management
Act, provided the public has been
notified of the Council’s intent to take
final action to address the emergency.
