of complying with the MTOR is borne
by clerical personnel along with
assistance from sales personnel. Staff
believes that the mean hourly income
for workers in sales and related
occupations is an appropriate measure
of a direct marketer’s average labor cost
to comply with the Rule. Thus, the total
annual labor cost to new and
established businesses for MTOR
compliance during the three-year period
for which OMB approval is sought
would be approximately $31,830,000
(1,764,390 hours × $18.04/hr.), rounded
to the nearest thousand. Relative to
direct industry sales, this total is
negligible.10
Estimated annual non-labor cost
burden: $0 or minimal.
The applicable requirements impose
minimal start-up costs, as businesses
subject to the Rule generally have or
obtain necessary equipment for other
business purposes, i.e., inventory and
order management, and customer
relations. For the same reason, staff
anticipates printing and copying costs to
be minimal, especially given that
telephone order merchants have
increasingly turned to electronic
communications to notify consumers of
delay and to provide cancellation
options. Staff believes that the above
requirements necessitate ongoing,
regular training so that covered entities
stay current and have a clear
understanding of federal mandates, but
that this would be a small portion of
and subsumed within the ordinary
training that employees receive apart
from that associated with the
information collected under the Rule.

HHS gives notice of a
decision to designate a class of
employees from the Ventron
Corporation, in Beverly, Massachusetts,
as an addition to the Special Exposure
Cohort (SEC) under the Energy
Employees Occupational Illness
Compensation Program Act of 2000. On
October 12, 2012, the Secretary of HHS
designated the following class of
employees as an addition to the SEC:
SUMMARY:
All Atomic Weapons Employees who
worked for the Ventron Corporation at its
facility in Beverly, Massachusetts, from
November 1, 1942, through December 31,
1948, for a number of work days aggregating
at least 250 work days, occurring either
solely under this employment, or in
combination with work days within the
parameters established for one or more other
classes of employees included in the Special
Exposure Cohort.
This designation will become
effective on November 11, 2012, unless
Congress provides otherwise prior to the
effective date. After this effective date,
HHS will publish a notice in the
Federal Register reporting the addition
of this class to the SEC or the result of
any provision by Congress regarding the
decision by HHS to add the class to the
SEC.
