QF87–560–011; EL12–99–000] Applied Energy LLC; Notice of Waiver Request Take notice that on August 17, 2012, pursuant to section 292.205(c) of the Commission’s Rules of Practices and Procedures, 18 CFR 292.205(c) (2011) and the amended Public Utility Regulatory Policies Act of 1978, Applied Energy LLC (Applied Energy) requested a limited waiver of the efficiency standard set forth in section 292.205(a)(2)(B) of the Commission’s regulations for the topping-cycle cogeneration facility owned and operated by Applied Energy located at the United States Naval Station in San Diego, California (‘‘Facility’’). Specifically, Applied Energy requests waiver of the efficiency standard for calendar year 2012. Any person desiring to intervene or to protest in this proceedings must file in accordance with Rules 211 and 214 of the Commission’s Rules of Practice and Procedure (18 CFR 385.211 and 385.214) on or before 5 p.m. Eastern time on the specified comment date. Protests will be considered by the Commission in determining the appropriate action to be taken, but will not serve to make protestants parties to the proceeding. Anyone filing a motion to intervene or protest must serve a copy of that document on the Petitioner.
