Public Notice
This constitutes notice, in accordance
with 18 CFR 385.2201(b), of the receipt
of prohibited and exempt off-the-record
communications.
Order No. 607 (64 FR 51222,
September 22, 1999) requires
Commission decisional employees, who
make or receive a prohibited or exempt
off-the-record communication relevant
to the merits of a contested proceeding,
to deliver to the Secretary of the
Commission, a copy of the
communication, if written, or a
summary of the substance of any oral
communication.
Prohibited communications are
included in a public, non-decisional file
associated with, but not a part of, the
decisional record of the proceeding.
Unless the Commission determines that
the prohibited communication and any
responses thereto should become a part
of the decisional record, the prohibited
off-the-record communication will not
be considered by the Commission in
reaching its decision. Parties to a
proceeding may seek the opportunity to
respond to any facts or contentions
made in a prohibited off-the-record
communication, and may request that
the Commission place the prohibited
communication and responses thereto
in the decisional record. The
Commission will grant such a request
only when it determines that fairness so
requires. Any person identified below as
having made a prohibited off-the-record
communication shall serve the
document on all parties listed on the
official service list for the applicable
proceeding in accordance with Rule
2010, 18 CFR 385.2010.
Exempt off-the-record
communications are included in the
decisional record of the proceeding,
unless the communication was with a
cooperating agency as described by 40
CFR 1501.6, made under 18 CFR
385.2201(e)(1)(v).

on July 5, 2012 1 and July 17, 2012,2 the
Federal Energy Regulatory Commission
(Commission) staff will hold a technical
conference on Thursday, August 30,
2012, from 9 a.m. to approximately 5:30
p.m. local time to discuss gas-electric
coordination issues in the Mid-Atlantic

In accordance with Section
122(i) of the Comprehensive
Environmental Response,
Compensation, and Liability Act of
1980, as amended (‘‘CERCLA’’), notice
is hereby given by the U.S.
Environmental Protection Agency
(‘‘EPA’’), Region 2, of a proposed de
minimis administrative settlement
agreement and order on consent
pursuant to Section 122(g)(4) of
CERCLA, between EPA and American
Axle & Manufacturing, Inc., Amersham
Health, Inc., Bishop & Associates, City
of San Diego, County Board of
Arlington, Virginia, Energy Solutions
Services, Inc., Scientific Ecology Group,
Inc., Genesys Regional Medical Center,
Ingot Metal Company, Ltd., Purina
Mills, LLC, Shred-A-Can Recyclers, Ltd.,
Triumvirate Environmental, Inc., and
Waste Management of Michigan, Inc.
(hereafter ‘‘Settling Parties’’) pertaining
to the Mercury Refining Superfund Site
(‘‘Site’’) located in the Towns of
Guilderland and Colonie, Albany

requires specified individual payments
by each Settling Party to the EPA
Hazardous Substance Superfund
Mercury Refining Superfund Site
Special Account, which combined total
$79,028.49. Each Settling Party’s
individual settlement amount is
considered to be that party’s fair share
of cleanup costs incurred and
anticipated to be incurred in the future,
plus a ‘‘premium’’ that accounts for,
among other things, uncertainties
associated with the costs of that future
work at the Site. The settlement
includes a covenant not to sue pursuant
to Sections 106 and 107 of CERCLA,
relating to the Site, subject to limited
reservations, and protection from
contribution actions or claims as
provided by Sections 113(f)(2) and
122(g)(5) of CERCLA. For thirty (30)
days following the date of publication of
this notice, EPA will receive written
comments relating to the settlement.
EPA will consider all comments
received and may modify or withdraw
its consent to the settlement if
comments received disclose facts or
considerations that indicate that the
proposed settlement is inappropriate,
improper, or inadequate.
EPA’s response to any comments
received will be available for public
inspection at EPA Region II, 290
Broadway, New York, New York 10007–
1866.
Comments must be submitted on
or before September 27, 2012.
