AGENCY:
The FDIC, as part of its
continuing effort to reduce paperwork
and respondent burden, invites the
general public and other Federal
agencies to take this opportunity to
comment on renewal of existing
information collections, as required by
the Paperwork Reduction Act of 1995
(44 U.S.C. chapter 35). Currently, the
FDIC is soliciting comments on renewal
of the information collections described
below.
DATES: Comments must be submitted on
or before September 28, 2012.

General Description of Collection:
With certain exceptions, section 24 of
the FDI Act (12 U.S.C. 1831a) limits the
direct equity investments of state
chartered banks to equity investments
that are permissible for national banks.
In addition, the statute prohibits an
insured state bank from directly
engaging as principal in any activity
that is not permissible for a national
bank or indirectly through a subsidiary
in an activity that is not permissible for
a subsidiary of a national bank unless
the bank meets its minimum capital
requirements and the FDIC determines
that the activity does not pose
significant risk to the Deposit Insurance
Fund. The FDIC can make such a
determination for exception by
regulation or by order. The FDIC’s
implementing regulation for section 24
is 12 CFR part 362. It details the
activities that insured state nonmember
banks or their subsidiaries may engage
in, under certain criteria and conditions,
and identifies the information that
banks must furnish to the FDIC in order
to obtain the FDIC’s approval or nonobjection.

General Description of Collection: The
elements of this collection are required
under section 504 of the Gramm-LeachBliley Act, Public Law l06–102. The
collection mandates notice requirements
and restrictions on a financial
institution’s ability to disclose
nonpublic personal information about
consumers to nonaffiliated third parties.
The collection also identifies affirmative
actions that consumers must take to
exercise their right to prevent banks
from sharing their information with
nonaffiliated parties.

AGENCY:
This notice updates the
payment rates for inpatient
rehabilitation facilities (IRFs) for
Federal fiscal year (FY) 2013 (for
discharges occurring on or after October
1, 2012 and on or before September 30,
2013) as required under section
1886(j)(3)(C) of the Social Security Act
(the Act). Section 1886(j)(5) of the Act
requires the Secretary to publish in the
Federal Register on or before the August
1 that precedes the start of each fiscal
year, the classification and weighting
factors for the IRF prospective payment
system’s (PPS) case-mix groups and a
description of the methodology and data
used in computing the prospective
payment rates for that fiscal year.
DATES: Effective Date: The updated IRF
prospective payment rates are effective
for IRF discharges occurring on or after
October 1, 2012 and on or before
September 30, 2013 (FY 2013).

Executive Summary
I. Purpose
