ACTION: Final rule.
AGENCY:
This regulation establishes
tolerances for residues of acetamiprid in
or on multiple commodities which are
identified and discussed later in this
document. Interregional Research
Project Number 4 (IR–4) requested these
tolerances under the Federal Food,
Drug, and Cosmetic Act (FFDCA).
DATES: This regulation is effective July
25, 2012. Objections and requests for
hearings must be received on or before
September 24, 2012, and must be filed
in accordance with the instructions
provided in 40 CFR part 178 (see also
Unit I.C. of the SUPPLEMENTARY
INFORMATION).

II. Summary of Petitioned-For
Tolerance
In the Federal Register of November
9, 2011 (76 FR 69690) (FRL–9325–1),
EPA issued a notice pursuant to FFDCA
section 408(d)(3), 21 U.S.C. 346a(d)(3),
announcing the filing of a pesticide
petition (PP 1E7919) by Interregional
Research Project Number 4 (IR–4), 500
College Road East, Suite 201 W,
Princeton, NJ 08540. The petition
requested that 40 CFR 180.578 be
amended by establishing tolerances for
residues of the insecticide acetamiprid,
N 1-[(6-chloro-3-pyridyl)methyl]- N 2cyano- N 1-methylacetamidine, in or on
asparagus at 0.8 ppm; Brassica, leafy
greens, subgroup 5B at 15 parts per
million (ppm); turnip greens at 15 ppm;
corn, sweet, kernel plus cob with husks
removed at 0.01 ppm; corn, sweet,
forage at 10 ppm; corn, sweet, stover at
30 ppm; vegetable, fruiting, group 8–10
at 0.20 ppm; fruit, citrus, group 10–10
at 0.50 ppm; fruit, pome, group 11–10
at 1.0 ppm; and Brassica, head and
stem, subgroup 5A at 1.20 ppm. It also
requested that upon approval of the
aforementioned tolerances, to remove
the established tolerances in 40 CFR
180.578 for fruit, citrus, group 10 at 0.50
ppm; fruit, pome, group 11 at 1.0 ppm;
vegetable, fruiting, group 8 at 0.20 ppm;
and vegetable, Brassica, leafy, group 5 at
1.20 ppm. The fruit, citrus, group 10;
fruit, pome, group 11; and vegetable,
fruiting, group 8 tolerances will be
superseded by the updated crop group
tolerances. The vegetable, Brassica,
leafy group 5 tolerance will be
superseded by the Brassica, leafy
greens, subgroup 5B and Brassica, head
and stem, subgroup 5A tolerances. That
