Section 742 of the Dodd-Frank Wall
Street Reform and Consumer Protection
Act (‘‘Dodd-Frank Act’’) 1 amended the
Commodity Exchange Act (‘‘CEA’’) to
provide that a person for which there is
a Federal regulatory agency,2 including
a broker or dealer (‘‘broker-dealer’’)
registered under section 15(b) (except
pursuant to paragraph (11) thereof) or
15C of the Exchange Act,3 shall not
enter into, or offer to enter into, a
foreign exchange (‘‘forex’’) transaction 4
with a person who is not an ‘‘eligible

rule’’).6 A Federal regulatory agency’s
