Under section 7 of the Act, the Foundation has initiated formal consultation with the Service’s, Office of Protected Resources, Endangered Species Act Interagency Cooperation Division, on this proposed seismic survey. We (i.e., National Marine Fisheries Service, Office of Protected Resources, Permits and Conservation Division), have also initiated formal consultation under section 7 of the Act with the Endangered Species Act Interagency Cooperation Division to obtain a Biological Opinion (Opinion) evaluating the effects of issuing an incidental harassment authorization for threatened and endangered marine mammals and, if appropriate, authorizing incidental take. We will conclude the formal section 7 consultation prior to making a determination on whether or not to issue the authorization.     If executed within the United States, its territories, possessions,

    The Army's rules for accessing records, contesting contents; and 
appealing initial agency determinations are contained in Army 
Regulation 340-21; 32 CFR part 505; or may be obtained from the system 
manager.
