Commission’s Findings and Order Granting Accelerated Approval of Proposed Rule Change Section 19(b) of the Act 5 directs the Commission to approve a proposed rule change of a self-regulatory organization if it finds that such proposed rule change is consistent with the requirements of the Act and the rules and regulations thereunder applicable to such organization. The Commission finds that the proposed rule change is consistent with the requirements of the Act, in particular the requirements of Section 17A of the Act,6 and the rules and regulations thereunder applicable to ICE Clear Europe. Specifically, the Commission finds that the proposed rule change is consistent with Section 17A(b)(3)(F) of the Act,7 which requires, among other things, that the rules of a registered clearing agency be designed to promote the prompt and accurate clearance and settlement of derivative agreements, contracts, and transactions because it will contribute to ICE Clear Europe ensuring settlement finality of certain transfer, clearing, and settlement orders under the Settlement Finality Legislation. ICE Clear Europe has requested that the Commission approve the proposed rule change on an accelerated basis for good cause shown. The Commission finds good cause for accelerating approval because these changes are required pursuant to the Settlement 5 15 U.S.C. 78s(b). 6 15 U.S.C. 78q–1. If ICE Clear Europe does not make the changes described in this rule proposal, ICE Clear Europe may be in contravention of home country and home region legislation. V.
