Case 2012–D005 was published in the
Federal Register as a final rule on
January 30, 2012 (77 FR 4630). The final
rule incorporated adjusted thresholds
for application of the World Trade
Organization Government Procurement
Agreement and the Free Trade
Agreements, as determined by the
United States Trade Representative.
This final rule incorporates additional
adjustments to trade agreements
thresholds and makes conforming
changes to clause dates, as applicable.

apportionment of the 2012 Pacific cod
total allowable catch (TAC) allocated to
trawl catcher vessels in the BSAI.
DATES: Effective 1200 hrs, Alaska local
time (A.l.t.), February 29, 2012, through
1200 hrs, A.l.t., April 1, 2012.

manages the groundfish fishery in the
BSAI exclusive economic zone
according to the Fishery Management
Plan for Groundfish of the Bering Sea
and Aleutian Islands Management Area
(FMP) prepared by the North Pacific
Fishery Management Council under
authority of the Magnuson-Stevens
Fishery Conservation and Management
Act. Regulations governing fishing by
U.S. vessels in accordance with the FMP
appear at subpart H of 50 CFR part 600
and 50 CFR part 679.
The A season apportionment of the
2012 Pacific cod TAC allocated to trawl
catcher vessels in the BSAI is 38,117
metric tons (mt) as established by the
final 2012 and 2013 harvest
specifications for groundfish in the
BSAI (77 FR 10669, February 23, 2012).
In accordance with § 679.20(d)(1)(i),
the Administrator, Alaska Region,
NMFS (Regional Administrator), has
determined that the A season
apportionment of the 2012 Pacific cod
TAC allocated to trawl catcher vessels
in the BSAI will soon be reached.
Therefore, the Regional Administrator is
establishing a directed fishing
allowance of 35,517 mt and is setting
aside the remaining 2,600 mt as bycatch
to support other anticipated groundfish

opportunity for public comment
pursuant to the authority set forth at 5
U.S.C. 553(b)(B) and § 679.25(c)(1)(ii) as
such requirement is impracticable and
contrary to the public interest. This
requirement is impracticable and

would prevent NMFS from responding
to the most recent fisheries data in a
timely fashion and would delay the
closure of directed fishing for Pacific
cod by catcher vessels using trawl gear
