The City of Chandler is seeking a waiver from the provisions of 49 CFR Section 222.9 (specifically, the VerDate Mar<15>2010 17:25 Feb 29, 2012 Jkt 226001 definition of a non-traversable curb) so that three existing public crossings (Ray Road (DOT #741579U), Pecos Road (DOT #741674P), and Germann Road (DOT #741676D)) can be deemed acceptable supplemental safety measures (SSM). The crossings, equipped with flashing lights, gates, and medians, comply with all requirements necessary to be ‘‘gates with medians or channelization devices’’ SSMs with non-traversable curbs; except that the posted highway speed limit is 45 mph instead of 40 mph as required in the definition. The City of Chandler is also seeking a waiver from the provisions of 49 CFR Section 222.35(b)(1) so that the active grade crossing warning devices at Commonwealth Avenue (DOT #741672B) and Frye Road (DOT #741673H) are not required to be equipped with constant warning time devices for the siding track at the crossings.
