residential washers which incorporate, at a
minimum: (a) A side wrapper; 4 (b) a base;
and (c) a drive hub; 5 and (4) any
combination of the foregoing subassemblies.
Excluded from the scope are stacked
washer-dryers and commercial washers. The
term ‘‘stacked washer-dryers’’ denotes
distinct washing and drying machines that
are built on a unitary frame and share a
common console that controls both the
washer and the dryer. The term ‘‘commercial
washer’’ denotes an automatic clothes
washing machine designed for the ‘‘pay per
use’’ market meeting either of the following
two definitions:
(1) (a) It contains payment system
electronics; 6 (b) it is configured with an
externally mounted steel frame at least six
inches high that is designed to house a coin/
token operated payment system (whether or
not the actual coin/token operated payment
system is installed at the time of
importation); (c) it contains a push button
user interface with a maximum of six
manually selectable wash cycle settings, with
no ability of the end user to otherwise modify
water temperature, water level, or spin speed
for a selected wash cycle setting; and (d) the
console containing the user interface is made
of steel and is assembled with security
fasteners; 7 or
(2) (a) It contains payment system
electronics; (b) the payment system
electronics are enabled (whether or not the
payment acceptance device has been
installed at the time of importation) such
that, in normal operation,8 the unit cannot
begin a wash cycle without first receiving a
signal from a bona fide payment acceptance
device such as an electronic credit card
reader; (c) it contains a push button user
interface with a maximum of six manually
selectable wash cycle settings, with no ability
of the end user to otherwise modify water
temperature, water level, or spin speed for a
selected wash cycle setting; and (d) the
console containing the user interface is made
of steel and is assembled with security
fasteners.
The products subject to this investigation
are currently classifiable under subheading
8450.20.0090 of the Harmonized Tariff
System of the United States (HTSUS).
Products subject to this investigation may
also enter under HTSUS subheadings
8450.11.0040, 8450.11.0080, 8450.90.2000,
and 8450.90.6000. Although the HTSUS
subheadings are provided for convenience
and customs purposes, the written

SUPPLEMENTARY INFORMATION: The
Magnuson-Stevens Fishery
Conservation and Management Act, 16
U.S.C. 1801 et seq., as amended by the
Sustainable Fisheries Act, Public Law
104–297, provided for the establishment
of an AP to assist in the collection and
evaluation of information relevant to the
development of any Fishery
Management Plan (FMP) or FMP
amendment for Atlantic HMS. NMFS
consults with and considers the
comments and views of AP members
when preparing and implementing
FMPs or FMP amendments for Atlantic
tunas, swordfish, billfish, and sharks.
The AP has previously consulted with
NMFS on: Amendment 1 to the Billfish
FMP (April 1999); the HMS FMP (April
1999); Amendment 1 to the HMS FMP
(December 2003); the Consolidated HMS
FMP (October 2006); and Amendments
1, 2, 3, 4 and 5 to the Consolidated HMS
FMP (April and October 2008, February
and September 2009, May 2010, and
September 2011); among other things.
At the March 2012 AP meeting, NMFS
plans to discuss overall bluefin tuna
management; revitalizing the swordfish

fishery; shark management measures
such as rebuilding scalloped
hammerhead, dusky, and blacknose
sharks and catch shares; and items
contained in the Advanced Notice of

management options/measures for HMS
fisheries. The meeting will also include
updates on the 2011 ICCAT meeting and
any implementation requirements;
electronic dealer reporting;
smoothhound shark management; and
recreational monitoring methods for
Atlantic HMS fisheries.
