Because we have concluded that the petitioned action to list barndoor, winter and/or smooth skates is not warranted, we do not need to designate critical habitat or consider the need to list other skate species on the basis of similarity of appearance, as requested by the petitioner. Petition Finding Based on the above information and the criteria specified in 50 CFR 424.14(b)(2), after reviewing the information contained in the petition and information readily available in our files, we conclude that the petition fails to present substantial scientific or commercial information indicating that the petitioned action concerning barndoor, smooth and/or winter skate may be warranted.
