SUPPLEMENTARY INFORMATION: The
Commission has received a complaint
filed on behalf of Knowles Electronics
LLC on December 7, 2011. The
complaint alleges violations of section
337 of the Tariff Act of 1930 (19 U.S.C.
1337) in the importation into the United
States, the sale for importation, and the
sale within the United States after
importation of certain silicon
microphone packages and products
containing same. The complaint names
Analog Devices Inc. of Norwood, MA;
Amkor Technology, Inc. of Chandler,
AZ and Avnet, Inc. of Phoenix, AZ.
The complainant, proposed
respondents, other interested parties,
and members of the public are invited
to file comments, not to exceed five
pages in length, on any public interest
issues raised by the complaint.
Comments should address whether
issuance of an exclusion order and/or a
cease and desist order in this
investigation would negatively affect the
public health and welfare in the United
States, competitive conditions in the
United States economy, the production
of like or directly competitive articles in
the United States, or United States
consumers.
In particular, the Commission is
interested in comments that:
(i) Explain how the articles
potentially subject to the orders are used
in the United States;
(ii) identify any public health, safety,
or welfare concerns in the United States
relating to the potential orders;
(iii) indicate the extent to which like
or directly competitive articles are
produced in the United States or are
otherwise available in the United States,
with respect to the articles potentially
subject to the orders; and
(iv) indicate whether Complainant,
Complainant’s licensees, and/or third
party suppliers have the capacity to
replace the volume of articles
potentially subject to an exclusion order
and a cease and desist order within a
commercially reasonable time.

Written submissions must be filed no
later than by close of business, five
business days after the date of
publication of this notice in the Federal
Register. There will be further
opportunities for comment on the
public interest after the issuance of any
final initial determination in this
investigation.
Persons filing written submissions
must file the original document and 12
true copies thereof on or before the
deadlines stated above with the Office
of the Secretary. Submissions should
refer to the docket number (‘‘Docket No.
2864’’) in a prominent place on the
cover page and/or the first page. The
Commission’s rules authorize filing
submissions with the Secretary by
facsimile or electronic means only to the
extent permitted by section 201.8 of the
rules (see Handbook for Electronic

authority of section 337 of the Tariff Act
of 1930, as amended (19 U.S.C. 1337),
and of sections 201.10 and 210.50(a)(4)
of the Commission’s Rules of Practice
and Procedure (19 CFR 201.10,
210.50(a)(4)).

Pistoia Alliance, Inc. has filed written
notifications simultaneously with the
Attorney General and the Federal Trade
Commission disclosing changes in its
membership. The notifications were
filed for the purpose of extending the
Act’s provisions limiting the recovery of
antitrust plaintiffs to actual damages
under specified circumstances.
Specifically, PerkinElmer, Inc.,
Waltham, MA; Connected Discovery,
London, UNITED KINGDOM; Fulcrum
Direct Limited, CBTC, Cardiff, UNITED
KINGDOM; The Hyve, Utrecht, THE
NETHERLANDS; and Peter Boogaard
(Individual), Moordrecht, THE
NETHERLANDS, have been added as
parties to this venture. Also, Allergan
Sales LLC, Irvine, CA; and
Cambridgesoft, Waltham, MA, have
withdrawn as parties to this venture. In
addition, Atlas Platform Corp. has
changed its name to GeneStack Limited,
Cambridge, UNITED KINGDOM.
No other changes have been made in
either the membership or planned
activity of the group research project.
Membership in this group research
project remains open, and Pistoia
Alliance, Inc. intends to file additional
written notifications disclosing all
changes in membership.
On May 28, 2009, Pistoia Alliance
filed its original notification pursuant to
Section 6(a) of the Act. The Department
of Justice published a notice in the
Federal Register pursuant to Section
6(b) of the Act on July 15, 2009 (74 FR
34364).
The last notification was filed with
the Department on August 17, 2011. A
notice was published in the Federal
Register pursuant to Section 6(b) of the
Act on September 21, 2011 (76 FR
58540).
