Preliminary Issues The interdisciplinary team has conducted field surveys and data research to identify preliminary issues of concern with this proposal. The primary concern is the potential for sediment or heavy metal discharges into streams from mining operations, potentially impacting water quality, fish and fish habitat (pools and temperature). Within the Granite Creek Watershed, under section 303(d) of the Clean Water Act, the Oregon Department of Environmental Quality (DEQ) has listed Beaver Creek and Clear Creek as water quality limited for temperature, and Bull Run Creek and Granite Creek as water quality limited for temperature and sediment. Fish species listed as threatened under the Endangered Species Act occurring within the watershed include bull trout and middle Columbia River steelhead trout. The most useful comments to developing or refining the proposed action would be site-specific concerns and those that pertain to authorizing mining activities within the Granite Creek Watershed Mining Plans analysis area that meets the Purpose of and Need for Action. T/IM authority could be granted for a period of up to two years. FTZ procedures could exempt SubZero from customs duty payments on the foreign components used in export production. The company anticipates that some 10 percent of the plant’s shipments will be exported. On its domestic sales, Sub-Zero would be able to choose the duty rate during customs entry procedures that applies to refrigerators (duty rate: free) for the foreign inputs noted above. In accordance with the Board’s regulations, Pierre Duy of the FTZ Staff is designated examiner to evaluate and analyze the facts and information presented in the application and case record and to report findings and recommendations pursuant to Board Orders 1347 and 1480. Public comment is invited from interested parties.
