TransCanada Keystone Pipeline, LP
(TransCanada Keystone) filed a request
for waiver of the requirement in 18 CFR
342.4(c) that it submit a verified
statement in support of future changes
to its committed rates.
TransCanada Keystone states that
good cause exists to grant such a waiver
because TransCanada Keystone’s
committed shippers have already agreed
in writing to the changes TransCanada
Keystone is contractually permitted to
make to its committed rates, and the
Commission has previously granted
such a waiver under these
circumstances.

and 214 of the Commission’s Rules of
Practice and Procedure (18 CFR 385.211

time on the specified comment date. It
is not necessary to separately intervene
again in a subdocket related to a
compliance filing if you have previously
intervened in the same docket. Protests
will be considered by the Commission
in determining the appropriate action to
be taken, but will not serve to make
protestants parties to the proceeding.
Anyone filing a motion to intervene or
protest must serve a copy of that
document on the Applicant. In reference
to filings initiating a new proceeding,
interventions or protests submitted on
or before the comment deadline need
not be served on persons other than the

AGENCY:
EPA approved Alaska’s
National Pollutant Discharge

application on October 31, 2008
pursuant to section 402 of the Clean
Water Act (CWA or ‘‘the Act’’). The
approved State program, called the
Alaska Pollutant Discharge Elimination
System (APDES), includes an
implementation plan that transfers the
administration of specific program
components from EPA to the Alaska
Department of Environmental

over a three year period from the date
of program approval. Phases I–III have
been transferred from EPA to ADEC.
Transfer of the final phase, Phase IV, is
currently scheduled for October 31,
2011. ADEC has made a submission for
approval for a one year extension of the
transfer of Phase IV of the APDES
program, which includes oil and gas,
cooling water intakes and dischargers,
munitions and all other remaining
facilities not previously transferred in
Phases I–III. If EPA approves the APDES
program revision, Phase IV will transfer
to ADEC four years from the date of
program approval, or October 31, 2012.
Today, EPA is requesting comments on
the proposed one year extension and is
providing notice of a public hearing and
