Application of the Energy Planning and Management Program Power Marketing Initiative to the Boulder Canyon Project

The Western Area Power Administration (Western), a Federal power marketing agency of the Department of Energy (DOE), will apply the Energy Planning and Management Program (Program) Power Marketing Initiative (PMI), as modified in this notice, to the Boulder Canyon Project (BCP), as proposed in a Federal Register notice (FRN) published on November 20, 2009. As a result, Western will extend a major percentage of the marketable capacity and energy to existing BCP customers. The remaining marketable resource shall form a resource pool that shall be marketed by Western to eligible customers by means of a public process. Western has determined that all BCP electric service contracts resulting from this effort shall have a term of thirty (30) years commencing October 1, 2017. Western is also making new proposals relative to the BCP remarketing effort including marketable capacity and energy, a resource pool percentage, and excess energy provisions, as described in this notice. Western is accepting public comments on these proposals. All comments previously submitted in response to Western's November 20, 2009, notice will be considered in this process and are not required to be resubmitted.

This rule changes Department regulations to broaden the authority of a consular officer to revoke a visa at any time subsequent to issuance of the visa, in his or her discretion. These changes to the Department's revocation regulations expand consular officer visa revocation authority to the full extent allowed by statute. Additionally, this rule change allows consular officers and designated officials within the Department to revoke a visa provisionally while considering a final visa revocation.

Version One Regional Reliability Standard for Transmission Operations

Under section 215(d)(2) of the Federal Power Act, the Federal Energy Regulatory Commission approves regional Reliability Standard TOP-007-WECC-1 (System Operating Limits) developed by the Western Electric Coordinating Council (WECC) and submitted to the Commission for approval by the North American Electric Reliability Corporation. The primary purpose of this regional Reliability Standard is to ensure that actual flows and associated scheduled flows on major WECC transfer paths do not exceed system operating limits for more than 30 minutes. The Commission also approves the retirement of WECC regional Reliability Standard TOP-STD-007-0, which is replaced by the regional Reliability Standard approved in this Final Rule. The Commission also directs WECC to modify the associated violation risk factors and violation severity levels.

This document responds to seven petitions for reconsideration submitted regarding our August 2004 final rule that amended the Federal motor vehicle safety standard on lamps, reflective devices, and associated equipment. After careful review of the petitions, we are revising certain requirements of the standard pertaining to the visibility of lamps mounted on motorcycles to increase the compatibility of our visibility requirements with those of theUnited Nations Economic Commission for Europe (ECE R53). We are otherwise denying the petitions.

This action is necessary for the protection of persons and vessels on navigable waters during the Blue Angels' air show. Entry into, transiting or anchoring in this zone is prohibited to all vessels, mariners, and persons unless specifically authorized by the Captain of the Port (COTP) Mobile or a designated representative.

This deviation is necessary to facilitate extensive rehabilitation and maintenance in order to maintain the bridge's operational integrity. Under this deviation, the bascule lift span of the drawbridge will remain in the closed-to-navigation position for the extent of the effective period.

The Coast Guard is changing the regulation governing the operation of the US 50 Bridge over Isle of Wight (Sinepuxent) Bay, mile 0.5, at Ocean City, MD. This rule will require any mariner requesting an opening in the evening hours during the off-season, to do so before the tender office has vacated for the night. The change will ensure draw tender availability for openings. The Coast Guard is also changing the waterway location from Isle of Wight Bay to Isle of Wight (Sinepuxent) Bay. This change is necessary because the waterway is known locally as both Isle of Wight Bay and Sinepuxent Bay. This change will ensure there is no confusion as to the referenced waterway.
Hydroplane Races Within the Captain of the Port Puget Sound Area of Responsibility

The Coast Guard will enforce the Special Local Regulation, Hydroplane Races within the Captain of the Port Puget Sound Area of Responsibility for the Tastin' n' Racin' hydroplane event in Lake Sammamish, WA from 9 a.m. through 6 p.m. on June 11, 2011 and from 9 a.m. through 6 p.m. on June 12, 2011. This action is necessary to restrict vessel movement in the vicinity of the race courses thereby ensuring the safety of participants and spectators during these events. During the enforcement period non-participant vessels are prohibited from entering the designated race areas. Spectator craft entering, exiting or moving within the spectator area must operate at speeds which will create a minimum wake.

This rule will enhance the safety of the contractors performing maintenance as well as the safety of the vessels that plan to transit this area between 10 a.m. and 4 p.m. on August 20, 2011.

The Marine Mammal Commission was created under Title II of the Marine Mammal Protection Act of 1972, as amended. The Commission is assisted in its duties by the Committee of Scientific Advisors on Marine Mammals. The Committee consists of nine members, appointed by the Chairman of the Commission. As a general rule, Committee members are appointed for three-year terms, which may be extended as necessary, but vacancies do not occur on a regularly scheduled basis. To assist the Commission in identifying qualified candidates for appointment to the Committee if and when vacancies occur, the Commission is soliciting nominations from the public.

However, we ask the public to submit to us any new information that becomes available concerning the status of, or threats to, the smooth-billed ani or its habitat at any time.
Endangered and Threatened Wildlife and Plants; 90-Day Finding on a Petition To List the Arapahoe Snowfly as Endangered or Threatened

We, the U.S. Fish and Wildlife Service, announce a 90-day finding on a petition to list the Arapahoe snowfly (Capnia arapahoe) as endangered or threatened under the Endangered Species Act of 1973, as amended (Act), and to designate critical habitat. Based on our review, we find that the petition presents substantial scientific or commercial information indicating that listing this species may be warranted. Therefore, with the publication of this notice, we are initiating a review of the status of the species to determine if listing the Arapahoe snowfly is warranted. To ensure that this status review is comprehensive, we are requesting scientific and commercial data and other information regarding this species. Based on the status review, we will issue a 12-month finding on the petition, which will address whether the petitioned action is warranted under the Act.

New Pneumatic Off-the-Road Tires From the People's Republic of China: Final Results of Countervailing Duty Administrative Review

The Department of Commerce (the Department) has conducted an administrative review of Hebei Starbright Tire Co., Ltd. (Starbright) under the countervailing duty order on certain new pneumatic off-the- road tires (OTR Tires) from the People's Republic of China (PRC) for the period December 17, 2007, through December 31, 2008. Following the preliminary results, we received comments from Starbright, Titan Tire Corporation (Titan), the petitioner in the original investigation, and Bridgestone Americas, Inc. and Bridgestone Americas Tire Operations, LLC (collectively Bridgestone), a domestic interested party in the original investigation. Based on our analysis of the comments, we have determined that no changes should be made in these final results. We determine that subsidies are being provided to Starbright for the production and export of OTR Tires from the PRC. The subsidy rate is set forth in the Final Results of Review section below.
