I. Additional Information About the
Proposed Consent Decree
This proposed consent decree would
resolve a lawsuit alleging that the
Administrator failed to perform a
nondiscretionary duty to grant or deny,
within 60 days of submission, an
administrative petition to object to a
CAA Title V permit issued by the New
Mexico Environment Department, Air
Quality Bureau to Williams Four
Corners LLC for the Sims Mesa Central
Delivery Point facility. Under the terms
of the proposed consent decree, EPA has
agreed to respond to the petition by
April 29, 2011, or within 30 days of the
entry date of this Consent Decree,
whichever is later. The proposed
consent decree further states that EPA
shall expeditiously deliver notice of
such action on the permit to the Office
of the Federal Register for publication.
In addition, the proposed consent
decree states that deadline for filing a
motion for costs of litigation (including
attorneys’ fees) is extended until 60
days after the decree is entered by the
court, that the parties shall seek to
resolve informally any claim for such
costs during those 60 days, and that if
they cannot they will submit the issue
to the court for resolution. The proposed
consent decree also states that, after
EPA fulfills its obligations under the
decree and the plaintiff’s claims for
costs of litigation have been resolved as
provided in the decree, the case shall be
dismissed with prejudice.
For a period of thirty (30) days
following the date of publication of this
notice, the Agency will accept written
comments relating to the proposed
consent decree from persons who were
not named as parties or intervenors to
the litigation in question. EPA or the
Department of Justice may withdraw or
withhold consent to the proposed
consent decree if the comments disclose
facts or considerations that indicate that
such consent is inappropriate,
improper, inadequate, or inconsistent
with the requirements of the Act. Unless
EPA or the Department of Justice
determines that consent to this consent
decree should be withdrawn, the terms
of the decree will be affirmed.

Background: The CASAC was
established pursuant to the under the
Clean Air Act (CAA) Amendments of
1977, codified at 42 U.S.C. 7409D(d)(2),
to provide advice, information, and
recommendations to the Administrator
on the scientific and technical aspects of
issues related to the criteria for air
quality standards, research related to air
quality, sources of air pollution, and the
strategies to attain and maintain air
quality standards and to prevent
significant deterioration of air quality.
The CASAC is a Federal Advisory
Committee chartered under the Federal
Advisory Committee Act (FACA), 5
U.S.C., App. 2. Pursuant to FACA and
EPA policy, notice is hereby given that
the CASAC AMMS CASAC AMMS will
hold a public teleconference to discuss
the Subcommittee’s draft peer review
report of the EPA’s draft monitoring
documents for NOX and SOX.
The AMMS met on February 16, 2011
to review EPA’s draft monitoring
documents for NOX and SOX and
proposed methods for assessing levels of
nitrogen and sulfur deposition. [Federal

February 2011 meeting are posted on
