4.0 Conclusion
Accordingly, the NRC has determined
that, pursuant to 10 CFR 50.12, the
exemption is authorized by law, will not
present an undue risk to the public
health and safety, and is consistent with
the common defense and security. Also,
special circumstances are present.
Therefore, the NRC hereby grants
Ameren a one-time exemption from the
requirements of 10 CFR 50.71(e)(3)(iii)
pertaining to the Callaway, Unit 2, COL
application to allow submittal of the
next FSAR update prior to any request
to the NRC to resume the review and,
in any event, no later than December 31,
2012.
Pursuant to 10 CFR 51.32, the NRC
has determined that the granting of this
exemption will not have a significant
effect on the quality of the human
environment (76 FR 800).
This exemption is effective upon
issuance.
