Preliminary data available through June 15, 2010 also are consistent with continued attainment. In accordance with section 113(g) of the Clean Air Act, as amended (``CAA'' or the ``Act''), 42 U.S.C. 7413(g), notice is hereby given of a proposed settlement agreement to address a lawsuit filed by the Louisiana Environmental Action Network in the United States District Court for the District of Columbia: Louisiana Environmental Action Network v. Jackson,. No 1:09-0133 (D. D.C.). On February 17, 2010, Plaintiff filed an amended complaint alleging that EPA failed to perform nondiscretionary duties under the Clean Air Act related to the attainment of National Ambient Air Quality Standards (NAAQS) for ozone in the Baton Rouge area. Specifically, they alleged that EPA failed to promulgate a Federal Implementation Plan to adopt regulations for the Baton Rouge area necessary to implement CAA requirements for ozone nonattainment areas that have been designated as ``severe'' nonattainment areas for the 1-hour ozone standard. The proposed settlement agreement establishes deadlines for EPA to take action on certain requirements related to the 1-hour and 1997 8-hour ozone standards.
