Transfer and Reorganization of Bank Secrecy Act Regulations
Document Number: 2010-25914
Type: Rule
Date: 2010-10-26
Agency: Department of the Treasury, Financial Crimes Enforcement Network
FinCEN is issuing this final rule to move the Bank Secrecy Act (BSA) regulations to a new chapter in the Code of Federal Regulations (CFR). The new chapter contains the BSA regulations, which are generally reorganized by financial industry. Moving the BSA regulations to a new chapter and organizing the chapter by financial industry creates a user-friendly way to find regulations applicable to a particular financial industry. This new organization within the new chapter also allows for the renumbering of the BSA regulations in a manner that makes it easier to find regulatory requirements than under the numbering system currently used in the existing regulations. FinCEN also makes minor technical changes to the BSA regulations such as updating mailing addresses and points of contact.

Notice of Availability: Notice of Funding Availability (NOFA) for Fiscal Year (FY) 2010 Continuum of Care (CoC) Homeless Assistance Program; Technical Correction
Document Number: 2010-27015
Type: Notice
Date: 2010-10-25
Agency: Department of Housing and Urban Development
On September 20, 2010, HUD posted on https://www.Grants.gov and https://www.hudhre.info its Notice of Funding Availability (NOFA) for HUD's FY2010 Continuum of Care Homeless Assistance Program. Today's Federal Register publication announces that HUD has posted on https:// www.Grants.gov and https://www.hudhre.info a technical correction that corrects Appendix A of the NOFA. Appendix A of the NOFA, the ``List of Counties Defined as Rural for the FY2010 Selection Criteria,'' inadvertently omitted listing six counties. As provided in the FY2010 CoC NOFA, counties listed on Appendix A and otherwise meeting the criteria described in Section III.C.2.a.(5) of the NOFA, are eligible for consideration for the selection priority described in Section V.B.2 of the NOFA. In addition, HUD determined that five counties not meeting the definition of rural county used in the FY2010 CoC NOFA were inadvertently included on the list of rural counties in Appendix A. As a result, HUD has corrected Appendix A. The revised CoC NOFA along with the corrected Appendix A can be found and downloaded from https://www.grants.gov and https:// www.hudhre.info. This correction does not change the application deadline date which remains November 18, 2010.

New Mexico: Final Authorization of State Hazardous Waste Management Program Revision
Document Number: 2010-26962
Type: Rule
Date: 2010-10-25
Agency: Environmental Protection Agency
The State of New Mexico has applied to the EPA for final authorization of changes to its hazardous waste program under the Resource Conservation and Recovery Act (RCRA). The EPA has determined that these changes satisfy all requirements needed to qualify for final authorization, and is authorizing the State's changes through this immediate final action. The EPA is publishing this rule to authorize the changes without a prior proposal because we believe this action is not controversial and do not expect comments that oppose it. Unless we receive written comments, which oppose this authorization during the comment period, the decision to authorize New Mexico's changes to its hazardous waste program will take effect. If we receive comments that oppose this action, we will publish a document in the Federal Register withdrawing this rule before it takes effect, and a separate document in the proposed rules section of this Federal Register will serve as a proposal to authorize the changes.

Type: Proposed Rule
Date: 2010-10-25
Agency: Environmental Protection Agency
The State of New Mexico has applied to EPA for Final authorization of the changes to its hazardous waste program under the Resource Conservation and Recovery Act (RCRA). EPA proposes to grant Final Authorization to the State of New Mexico. In the ``Rules and Regulations'' section of this Federal Register, EPA is authorizing the changes by an immediate final rule. EPA did not make a proposal prior to the immediate final rule because we believe this action is not controversial and do not expect comments that oppose it. We have explained the reasons for this authorization in the preamble to the immediate final rule. Unless we get written comments which oppose this authorization during the comment period, the immediate final rule will become effective on the date it establishes, and we will not take further action on this proposal. If we receive comments that oppose this action, we will withdraw the immediate final rule and it will not take effect. We will then respond to public comments in a later final rule based on this proposal. You may not have another opportunity for comment. If you want to comment on this action, you must do so at this time.

Record of Decision (ROD) for the Implementation of the Base Closure and Realignment (BRAC) 2005 Actions at Fort Monroe, VA
Document Number: 2010-26923
Type: Notice
Date: 2010-10-25
Agency: Department of Defense, Department of the Army, Army Department
The Department of the Army announces the availability of the ROD, which summarizes the decision on how to implement property disposal in accordance with the Defense Base Closure and Realignment Act of 1990 (the Base Closure Act), Public Law 101-510, as amended, following the closure of Fort Monroe, Virginia. The Army has decided to implement its preferred alternative of early transfer of surplus non-reverting federal property to other entities for reuse. Pursuant to the National Environmental Policy Act of 1969 (NEPA) and its implementing regulations, the Army prepared a Final Environmental Impact Statement (FEIS) that includes the evaluation of the environmental and socioeconomic impacts of disposing of surplus Federal property that does not revert to the Commonwealth of Virginia, and the implementation by others of reasonable, foreseeable reuse alternatives for the entire property. Under the early transfer alternative, the Army can transfer and dispose of non-reverting property for redevelopment before environmental remedial actions have been completed. This method of early disposal, allowable under Section 120(h)(3)(C) of the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA), would defer the CERCLA covenant requirement to complete all necessary environmental cleanup prior to the transfer of the remediated property. In this way, parcels could become available for redevelopment and reuse sooner under this disposal alternative than under any other. The Governor of the Commonwealth of Virginia must concur with the deferral request for the non-reversionary property at Fort Monroe.
