November 1, 2010.
This constitutes notice, in accordance
with 18 CFR 385.2201(b), of the receipt
of prohibited and exempt off-the-record
communications.
Order No. 607 (64 FR 51222,
September 22, 1999) requires
Commission decisional employees, who
make or receive a prohibited or exempt
off-the-record communication relevant
to the merits of a contested proceeding,
to deliver to the Secretary of the
Commission, a copy of the
communication, if written, or a
summary of the substance of any oral
communication.
Prohibited communications are
included in a public, non-decisional file
associated with, but not a part of, the
decisional record of the proceeding.
Unless the Commission determines that
the prohibited communication and any
responses thereto should become a part
of the decisional record, the prohibited
off-the-record communication will not
be considered by the Commission in
reaching its decision. Parties to a
proceeding may seek the opportunity to
respond to any facts or contentions
made in a prohibited off-the-record
communication, and may request that
the Commission place the prohibited
communication and responses thereto
in the decisional record. The
Commission will grant such a request
only when it determines that fairness so
requires. Any person identified below as
having made a prohibited off-the-record
communication shall serve the
document on all parties listed on the
Docket No.
official service list for the applicable
proceeding in accordance with Rule
2010, 18 CFR 385.2010.

(SA) and database administration (DBA) as required to support OPPT
computer applications; OPPT staff; and their development staff.
Specific types of duties will be configuration changes; assistance in
backups/restoration of data; installation of operating system
maintenance; database maintenance; troubleshooting problems; and
security fixes. Routine performance of these duties does not require
access to TSCA CBI data.
In accordance with 40 CFR 2.306(j), EPA has determined that under
EPA contract number GS-35F-4381G, Task Order Number 1659, CSC and Its
Identified Subcontractors will require access to CBI submitted to EPA
under all sections of TSCA to perform successfully the duties specified
under the contract. CSC and Its Identified Subcontractors' personnel
will be given access to information submitted to EPA under all sections
of TSCA. Some of the information may be claimed or determined to be
CBI.
EPA is issuing this notice to inform all submitters of information
under all sections of TSCA that EPA may provide CSC and Its Identified
Subcontractors access to these CBI materials on a need-to-know basis
only. All access to TSCA CBI under this contract will take place at EPA
Headquarters and the Research Triangle Park facilities in accordance
with EPA's TSCA CBI Protection Manual.
Access to TSCA data, including CBI, will continue until September
30, 2016. If the contract is extended, this access will also continue
for the duration of the extended contract without further notice.
CSC and Its Identified Subcontractors' personnel will be required
to sign nondisclosure agreements and will be briefed on appropriate
security procedures before they are permitted access to TSCA CBI.
