ACTION: Notice of the OMB review of
information collection and solicitation
of public comment.
AGENCY:
The NRC has recently
submitted to OMB for review the
following proposal for the collection of
information under the provisions of the
Paperwork Reduction Act of 1995
(44 U.S.C. Chapter 35). The NRC hereby
informs potential respondents that an
agency may not conduct or sponsor, and
that a person is not required to respond
to, a collection of information unless it
displays a currently valid OMB control
number. The NRC published a Federal
Register Notice with a 60-day comment
period on this information collection on
July 7, 2010.

5. How often the collection is
required: Certain licensees possessing
strategic SNM are required to report
inventories every six months. Licensees
possessing SNM of moderate strategic
significance must report every nine
months. Licensees possessing SNM of
low strategic significance must report
annually, except three licensees must
report their dynamic inventories every
two months and a static inventory on an
annual basis.
6. Who will be required or asked to
report: Fuel facility licensees possessing
special nuclear material.
7. An estimate of the number of
annual responses: 31.
8. The estimated number of annual
respondents: 10.
9. An estimate of the total number of
hours needed annually to complete the
requirement or request: 124 hours
(4 hours per response × 31 responses).
10. Abstract: NRC Form 327 is
submitted by fuel facility licensees to
account for special nuclear material.
The data is used by NRC to assess
licensee material control and accounting
programs and to confirm the absence of
(or detect the occurrence of) SNM theft
or diversion. NUREG/BR–0096 provides
specific guidance and instructions for
completing the form in accordance with
the requirements appropriate for a
particular licensee.

to the Paperwork Reduction Act of 1995
(44 U.S.C. 3501 et seq.), the Securities
and Exchange Commission
(‘‘Commission’’) has submitted to the
Office of Management and Budget
(‘‘OMB’’) a request for extension of the
previously approved collection of
information discussed below.
The title for the collection of
information is ‘‘Rule 203–2 (17 CFR
275.203–2) and Form ADV–W (17 CFR
279.2) under the Investment Advisers
Act of 1940 (15 U.S.C. 80b).’’ Rule 203–
2 under the Investment Advisers Act of
1940 establishes procedures for an
investment adviser to withdraw its
registration with the Commission. Rule
203–2 requires every person
withdrawing from investment adviser
registration with the Commission to file
Form ADV–W electronically on the
Investment Adviser Registration
Depository (‘‘IARD’’). The purpose of the
information collection is to notify the
Commission and the public when an
investment adviser withdraws its
pending or approved SEC registration.
Typically, an investment adviser files a
Form ADV–W when it ceases doing
business or when it is ineligible to
remain registered with the Commission.

The potential respondents to this
information collection are all
investment advisers registered with the
Commission. The Commission has
estimated that compliance with the
requirement to complete Form ADV–W
imposes a total burden of approximately
0.75 hours (45 minutes) for an adviser
filing for full withdrawal and
approximately 0.25 hours (15 minutes)
for an adviser filing for partial
withdrawal. Based on historical filings,
the Commission estimates that there are
approximately 500 respondents
annually filing for full withdrawal and
approximately 500 respondents
annually filing for partial withdrawal.
Based on these estimates, the total
estimated annual burden would be 500
hours ((500 respondents × .75 hours) +
(500 respondents × .25 hours)).
Rule 203–2 and Form ADV–W do not
require recordkeeping or records
retention. The collection of information
requirements under the rule and form
are mandatory. The information
collected pursuant to the rule and Form
ADV–W are filings with the
Commission. These filings are not kept
confidential. An agency may not
conduct or sponsor, and a person is not
required to respond to, a collection of
information unless it displays a
currently valid control number.

information discussed below.
Rule 17a–7 (17 CFR 240.17a–7) under
the Securities Exchange Act of 1934 (15
U.S.C. 78a et seq.) (‘‘Exchange Act’’)
requires non-resident broker-dealers
registered or applying for registration
pursuant to Section 15 of the Exchange
Act to maintain—in the United States—
complete and current copies of books
and records required to be maintained
under any rule adopted under the
Exchange Act. Alternatively,
Rule 17a–7 provides that non-resident
broker-dealers may sign written
undertakings to furnish the requisite
books and records to the Commission
upon demand.
There are approximately 63 nonresident broker-dealers. Based on the
Commission’s experience in this area, it
is estimated that the average amount of
time necessary to preserve the books
and records required by Rule 17a–7 is
one hour per year. Accordingly, the total
burden is 63 hours per year. With an
average cost per hour of approximately
$294, the total cost of compliance for
the respondents is approximately
$18,522 per year.
An agency may not conduct or

control number.
