In accordance with the
procedures governing the application
for, and the processing of, special

Regulations (49 CFR Part 107, Subpart
B), notice is hereby given that the Office
of Hazardous Materials Safety has
received the application described
herein. Each mode of transportation for
which a particular special permit is
requested is indicated by a number in
the ‘‘Nature of Application’’ portion of
the table below as follows: 1—Motor
vehicle, 2—Rail freight, 3—Cargo vessel,
4—Cargo aircraft only, 5—Passengercarrying aircraft.
Comments must be received on
or before September 24, 2010.
Comments should refer to the
application number and be submitted in
triplicate. If confirmation of receipt of
comments is desired, include a selfaddressed stamped postcard showing
the special permit number.

ACTION:
The U.S. Department of the
Treasury, as part of its continuing effort
to reduce paperwork and respondent
burden, invites the general public and
other Federal agencies to take this
opportunity to comment on proposed
and/or continuing information
collections, as required by the
Paperwork Reduction Act of 1995, 44
U.S.C. 3506(c)(2)(A). Currently, the
Community Development Financial
Institutions (CDFI) Fund, Department of
the Treasury, is soliciting comments
concerning the New Markets Tax Credit
(NMTC) Program—Allocation
Application (hereafter, the Application).
DATES: Written comments must be
received on or before October 25, 2010
to be assured of consideration.

in the Consolidated Appropriations Act,
2001 (Pub. L. 106–554, December 21,
2000), amended the Internal Revenue
Code (IRC) by adding IRC § 45D and
created the NMTC Program. The
Department of the Treasury, through the
CDFI Fund, administers the NMTC
Program, which provides an incentive to
investors in the form of tax credits over
seven years that stimulates private
investment capital that, in turn,
facilitates economic and community
development in low-income
communities. In order to receive the tax
credit, taxpayers make Qualified Equity
Investments (QEIs) in Community
Development Entities (CDEs):
substantially all of the QEI proceeds
must in turn be used by the CDE to
provide investments in businesses and
real estate developments in low-income
communities.
The tax credit provided to the
investor totals 39 percent of the amount
of the investment and is claimed over a
seven-year period. In each of the first
three years, the investor receives a
credit equal to five percent of the total
amount paid for the stock or capital
interest at the time of purchase. For the
final four years, the value of the credit
is six percent annually. Investors may
not redeem their investments in CDEs
prior to the conclusion of the seven-year
period without forfeiting any credit
amounts they have received.
