Tank 7 In-conduit Hydroelectric Project

generating units with a total installed
capacity of 590 kilowatts, (3) a proposed
24-inch-diameter discharge pipeline;
and (4) appurtenant facilities. The
applicant estimates the project would
have an average annual generation of
1.75 gigawatt-hours.

r. Waiver of Pre-filing Consultation: In
a letter dated April 1, 2010, the
applicant requested the agencies’
support to waive the Commission’s
consultation requirements under 18 CFR
4.38(c). The U.S. Fish and Wildlife
Service, in response to the request,
recommended that a habitat assessment
be completed to assess the actual
potential for federally listed species to
occur within the project area. No other

intend to accept the consultation that
has occurred on this project during the
pre-filing period and we intend to waive
pre-filing consultation under section
4.38(c), which requires, among other
things, conducting studies requested by
