prevent a violation of the provisions
of—
(1) The Atomic Energy Act;
(2) Title II of the Energy
Reorganization Act of 1974; or
(3) A regulation or order pursuant to
those Acts.
(b) The Commission may obtain a
court order for the payment of a civil
penalty imposed under section 234 of
the Atomic Energy Act:
(1) For violations of:
(i) Sections 53, 57, 62, 63, 81, 82, 101,
103, 104, 107, or 109 of the Atomic
Energy Act;
(ii) Section 206 of the Energy
Reorganization Act;
(iii) Any rule, regulation, or order
issued pursuant to the sections specified
in paragraph (b)(1)(i) of this section;
(iv) Any term, condition, or limitation
of any license issued under the sections
specified in paragraph (b)(1)(i) of this
section.
(2) For any violation for which a
license may be revoked under section
186 of the Atomic Energy Act.

(1) A production or utilization
facility.
(2) Five effective kilograms or more of
plutonium, high-enriched uranium or
uranium-233.
(3) 10,000 kilograms or more of heavy
water. (Note: Does not apply to exports

(4) Nuclear grade graphite for nuclear
end use.
(5) Radioactive waste.
(c) The Commission will also publish
in the Federal Register a notice of
receipt of a license application,
including applications for amendment
or renewal, for an import of radioactive
waste for which a specific license is
required.

Use of Government Lands

ACTION: Final rule.
In accordance with the
Commission’s regulations, the
Commission by its designee, the
Executive Director, is updating its
schedule of fees for the use of
government lands. The yearly update is
based on the most recent schedule of
fees for the use of linear rights-of-way
prepared by the United States Forest
Service. Since the next fiscal year will
cover the period from October 1, 2009
through September 30, 2010 the fees in
this rule will become effective October
1, 2010. The fees will apply to fiscal
year 2010 annual charges for the use of
government lands.
