Hydroelectric Project (FERC Project No.
12775–001), located on Spearfish Creek
near the city of Spearfish, in Lawrence
County, South Dakota. The existing, but
unlicensed project occupies a total of
57.26 acres of federal lands within the
Black Hills National Forest managed by
the U.S. Forest Service.
Staff prepared a draft environmental
assessment (EA), which analyzes the
potential environmental effects of
licensing the project, and concludes that
licensing the project, with appropriate
environmental protective measures,
would not constitute a major federal
action that would significantly affect the
quality of the human environment.
A copy of the draft EA is available for
review at the Commission in the Public
Reference Room or may be viewed on
the Commission’s Web site at
www.ferc.gov using the ‘‘eLibrary’’ link.

Southern California Edison Company,

the Commission to rule that the
California Public Utilities Commission’s
(CPUC) Decision 09–12–042 violates the
Federal Power Act, 16 U.S.C. 824, et
seq., and the Supremacy Clause of the
United States Constitution insofar as it
sets the rate for electric energy that is
sold at wholesale in interstate
commerce by public utilities, and does
so outside the CPUC’s authority under
the Public Utility Regulatory Policies
Act of 1978, 16 U.S.C. 824–a–1, et seq.
Any person desiring to intervene or to
protest this filing must file in
accordance with Rules 211 and 214 of
the Commission’s Rules of Practice and
Procedure (18 CFR 385.211, 385.214).
Protests will be considered by the
Commission in determining the
appropriate action to be taken, but will
not serve to make protestants parties to
the proceeding. Any person wishing to
become a party must file a notice of
intervention or motion to intervene, as
appropriate. Such notices, motions, or
