Take notice that on May 4, 2010, pursuant to Rule 207 of the Federal Energy Regulatory Commission’s (Commission) Rules of Practice and Procedure, 18 CFR 385.207, the Public Utilities Commission of the State of California (CPUC) filed a petition for declaratory order, requesting the Commission to find that the decisions, which promote Combined Heat and Power systems (i.e., cogeneration) of 20 megawatts or less, are not preempted by the Federal Power Act (FPA), 16 U.S.C. 824, et seq., Public Utilities Regulatory Policies Act (PURPA), 16 U.S.C. 824–a– 1, et seq., or Commission regulations. The CPUC also requests exemption from paying filing fees, pursuant to Rule 207(c) of the Commission Rules, 18 CFR 385.207(c), and 18 CFR 381.108(a). Any person desiring to intervene or to protest this filing must file in accordance with Rules 211 and 214 of the Commission’s Rules of Practice and Procedure (18 CFR 385.211, 385.214). Protests will be considered by the Commission in determining the appropriate action to be taken, but will not serve to make protestants parties to the proceeding.
