ACTION: Final rule.
SUMMARY: In the Order on
Reconsideration, the Commission
modifies the automatic roaming
obligation that the Commission adopted
for voice and related services in 2007 by
eliminating the home roaming
exclusion.

Synopsis of the Order on
Reconsideration Section of the Order
on Reconsideration and Second Further
Notice of Proposed Rulemaking
I. Introduction
1. In this order, the Commission takes
action to increase consumers’ access to
seamless nationwide mobile services,
wherever and whenever they choose,
and to promote investment, innovation,
and competition in mobile wireless
services. In the Order on
Reconsideration, the Commission
creates a framework for voice roaming
that will encourage carriers of all sizes
to reach reasonable commercial roaming
agreements, while also encouraging
these carriers to continue investing in
the coverage and capacity of their
networks. The Commission will
adjudicate any disputes that may arise
between carriers through a tailored, factbased process. In the Second FNPRM,
consistent with the recommendation of
the National Broadband Plan, the
Commission opens an examination of
the critical issue of data roaming, by
seeking comment on the rules that
should apply to roaming for mobile data
services such as mobile broadband
service.
2. First, in the Order on
Reconsideration, the Commission
modifies the automatic roaming
obligation that the Commission adopted
for voice and related services in 2007 by
eliminating the home roaming
exclusion. With this decision, the
Commission continues to strive to adopt
policies that balance competing
interests, including—promoting
competition among multiple carriers;
ensuring that consumers have access to
seamless coverage nationwide; and
providing incentives for all carriers to
invest and innovate by using available
