The Captain of the Port, Sector Lake
Michigan, or his or her on-scene
representative may terminate this
operation at any time.
(c) Regulations. (1) In accordance with
the general regulations in § 165.23 of
this part, entry into, transiting, or
anchoring within this safety zone is
prohibited unless authorized by the
Captain of the Port, Sector Lake
Michigan, or his or her on-scene
representative.
(2) This safety zone is closed to all
vessel traffic, except as may be
permitted by the Captain of the Port,
Sector Lake Michigan, or his or her onscene representative.
(3) The ‘‘on-scene representative’’ of
the Captain of the Port, Sector Lake
Michigan, is any Coast Guard
commissioned, warrant or petty officer
who has been designated by the Captain
of the Port, Sector Lake Michigan, to act
on his or her behalf. The on-scene
representative of the Captain of the Port,
Sector Lake Michigan, will be aboard
either a Coast Guard or Coast Guard
Auxiliary vessel.
(4) Vessel operators desiring to enter
or operate within the safety zone shall
contact the Captain of the Port, Sector
Lake Michigan, or his or her on-scene
representative to obtain permission to
do so. The Captain of the Port, Sector
Lake Michigan, or his or her on-scene
representative may be contacted via
VHF Channel 16. Vessel operators given
permission to enter or operate in the
safety zone must comply with all
directions given to them by the Captain
of the Port, Sector Lake Michigan, or his
or her on-scene representative.

SUMMARY: The Coast Guard will enforce
the safety zone for annual fireworks
events in the Captain of the Port, Sector
Lake Michigan, during four separate
periods between 9:15 p.m. on June 12,
2010 and 10:30 p.m. on June 24, 2010.
This action is necessary and intended to
ensure safety of life on the navigable
waters of the United States immediately
prior to, during, and immediately after
fireworks events. This action will
establish restrictions upon, and control
movement of, vessels in a specified area
immediately prior to, during, and
immediately after fireworks events.
During the enforcement period, no
person or vessel may enter the safety
zones without permission of the Captain
of the Port, Sector Lake Michigan.
DATES: The regulations in 33 CFR
165.935 will be enforced during four
separate periods between 9:15 p.m. on
June 12, 2010 and 10:30 p.m. on June
24, 2010.

SUPPLEMENTARY INFORMATION: The Coast
Guard will enforce the safety zone listed
in 33 CFR 165.935, Safety Zones,
Milwaukee Harbor, Milwaukee, WI, for
the following events:
(1) Pridefest fireworks display on June
12, 2010 from 9:15 p.m. through 10 p.m.
(2) Polish Festival fireworks display
on June 18, 2010 from 9:15 p.m. through
10 p.m.; on June 19, 2010 from 9:15 p.m.
through 10 p.m.
(3) Summerfest fireworks display on
June 24, 2010 from 9:15 p.m. through
10:30 p.m.
All vessels must obtain permission
from the Captain of the Port, Sector Lake
Michigan, or his or her on-scene
representative to enter, move within, or
exit the safety zone. Vessels and persons
granted permission to enter the safety
zone shall obey all lawful orders or
directions of the Captain of the Port,
Sector Lake Michigan, or his or her onscene representative. While within a
safety zone, all vessels shall operate at
the minimum speed necessary to
maintain a safe course.
This notice is issued under authority
of 33 CFR 165.935 Safety Zone,
Milwaukee Harbor, Milwaukee, WI and
5 U.S.C. 552(a). In addition to this
notice in the Federal Register, the Coast
Guard will provide the maritime
community with advance notification of
these enforcement periods via broadcast
Notice to Mariners or Local Notice to

Ethoxylated; Exemption from the
Requirement of a Tolerance
AGENCY: Environmental Protection
Agency (EPA).
ACTION: Final rule.
SUMMARY: This regulation establishes an
exemption from the requirement of a
tolerance for residues of phosphate
ester, tallowamine, ethoxylated (CAS
Reg. No. 68308–48–5), herein referred to
in this document as PETAE when used
as an inert ingredient at a maximum of
20% by weight in pesticide
formulations applied in or on growing
crops. Huntsman Corporation submitted
a petition to EPA under the Federal
Food, Drug, and Cosmetic Act (FFDCA),
requesting establishment of an
exemption from the requirement of a
tolerance. This regulation eliminates the
need to establish a maximum
permissible level for residues of PETAE.
DATES: This regulation is effective April
28, 2010. Objections and requests for
hearings must be received on or before
June 28, 2010, and must be filed in
accordance with the instructions
provided in 40 CFR part 178 (see also
Unit I.C. of the SUPPLEMENTARY
INFORMATION).
