Abstract: EPA is required under
Section 183(e) of the Clean Air Act to
regulate Volatile Organic Compound
(VOC) emissions from the use of
consumer and commercial products.
Under regulations promulgated on
February 26, 2007 (72 FR 8428)
manufacturers of new portable gasoline
containers are required to obtain
certificates of conformity with the Clean
Air Act, effective January 1, 2009. This
ICR covers the burdens associated with
this certification process. EPA reviews
information submitted in the
application for certification to
determine if the container design
conforms to applicable requirements
and to verify that the required testing
has been performed. The certificate
holder is required to keep records on the
testing and collect and keep warranty
and defect information for annual
reporting on in-use performance of their
products. The respondent must also
retain records on the units produced,
apply serial numbers to individual
containers, and track the serial numbers
to their certificates of conformity. Any
information submitted for which a claim
of confidentiality is made is safeguarded
according to EPA regulations at 40 CFR
2.201 et seq.
Burden Statement: The annual public
reporting and recordkeeping burden for
this collection of information is
estimated to average 63.8 hours for an
average of two responses per year.

Cleaning was promulgated on December
2, 1994 (59 FR 61805), and amended to

1995 (60 FR 29485), and December 11,
1998 (63 FR 68400). Owners or
operators of the affected facilities must
make an initial notification,
performance tests, periodic reports, and
maintain records of the occurrence and
duration of any startup, shutdown, or
malfunction in the operation of an
affected facility, or any period during
which the monitoring system is
inoperative. Reports, at a minimum, are
required semiannually.
Burden Statement: The annual public

this collection of information is
estimated to average 14 hours per
response. Burden means the total time,
effort, or financial resources expended
by persons to generate, maintain, retain,

regulations have not changed over the
past three years and are not anticipated
to change over the next three years; and
(2) the growth rate for the respondents
is very low, negative or non-existent.
Therefore, the labor hours in the
previous ICR reflect the current burden
to the respondents and are reiterated in
this ICR.
There is an increase in both
Respondent and Agency costs resulting
from labor rate increases from 2003 to
