initial development application, which
has already been given, established the

applications or notices of intent. Under
the Commission’s regulations, any

notice.
o. Procedural schedule: The
application will be processed according
to the following Hydro Licensing
Schedule. Revisions to the schedule will
be made as appropriate. The
Commission staff proposes to issue one
environmental assessment rather than
issue a draft and final EA. Comments,
terms and conditions,
recommendations, prescriptions, and
reply comments, if any, will be
addressed in an EA. Staff intents to give
at least 30 days for entities to comment
on the EA, and will take into
consideration all comments received on
the EA before final action is taken on
the license application.

p. A license applicant must file no
later than 60 days following the date of
issuance of this notice: (1) A copy of the
water quality certification; (2) a copy of
the request for certification, including
proof of the date on which the certifying
agency received the request; or (3)
evidence of waiver of water quality
certification.

Complaint
March 26, 2010.
Take notice that on March 25, 2010,
Central Transmission, LLC (Central
Transmission) filed a complaint against
the PJM Interconnection L.L.C. (PJM)
pursuant to section 206 of the Federal
Power Act (FPA), alleging that Schedule
6 of the PJM Operating Agreement and
Schedule 12 of the PJM Open Access
Transmission Tariff are unjust and
unreasonable and unduly
discriminatory in violation of FPA
section 206 insofar as the provisions (i)
could prevent PJM from designating
Central Transmission to construct and
own a transmission project; (ii) under
the same cost recovery provisions in
Schedule 12 of the PJM Tariff on the
same terms and conditions that are
available to those entities that currently
own transmission facilities that
comprise the PJM transmission system.
Central Transmission certifies that
copies of the complaint were served on
the contacts for Respondent as listed on
the Commission’s list of Corporate
Officials.
Any person desiring to intervene or to
protest this filing must file in
accordance with Rules 211 and 214 of
the Commission’s Rules of Practice and
Procedure (18 CFR 385.211, 385.214).
Protests will be considered by the
Commission in determining the
appropriate action to be taken, but will
not serve to make protestants parties to
the proceeding. Any person wishing to
become a party must file a notice of
intervention or motion to intervene, as
appropriate. The Respondent’s answer
and all interventions, or protests must
be filed on or before the comment date.
The Respondent’s answer, motions to
intervene, and protests must be served
on the Complainants.
