Background: Beginning in 2006, the
FAA asked the International Aircraft
Systems Fire Protection Working Group
(IASFPWG) to draft a revision to the
current AC 20–42C, issued on March
1984, by incorporating updated
guidance for the fire-fighting
effectiveness, selection, location,
mounting and safe-use of hand fire
extinguishers in aircraft. The proposed
AC also identifies three FAA approved
replacement agents for Halon 1211 and
establishes an FAA approved minimum
performance standard (MPS) for halon
replacement agents which includes a
hidden fire test and a seat fire/toxicity
test. We also recommend that users of
halon extinguishers transition to using
these new halocarbon clean replacement
agents in hand-held fire extinguishers.
The AC also explains how to gain

Background
Under 49 U.S.C. 31136(e) and 31315,
FMCSA may grant an exemption for a 2year period if it finds ‘‘such exemption
would likely achieve a level of safety
that is equivalent to, or greater than, the
level that would be achieved absent
such exemption.’’ The statute also
allows the Agency to renew exemptions
at the end of the 2-year period. The 53
individuals listed in this notice have
recently requested an exemption from
the diabetes prohibition in 49 CFR
391.41(b)(3), which applies to drivers of
CMV in interstate commerce.
Accordingly, the Agency will evaluate
the qualifications of each applicant to
determine whether granting the
Frm 00165
Fmt 4703
Sfmt 4703
exemption will achieve the required
level of safety mandated by the statutes.
