The sole purpose of a preliminary permit, if issued, is to grant the permit holder priority to file a license application during the permit term. A preliminary permit does not authorize the permit holder to perform any land disturbing activities or otherwise enter upon lands or waters owned by others without the owners’ express permission. The proposed project would consist of the following: (1) 8 VLH 4000 low head units; (2) a switchyard; (3) a 1⁄2-mile-long transmission line; and (4) appurtenant facilities. The proposed Green River Lock and Dam No. 4 Hydroelectric Project would have an average annual generation of 17.5 gigawatt-hours. Take notice that on February 4, 2010, North Baja Pipeline, LLC (NBP), filed an abbreviated application under section 7(c) of the Natural Gas Act to amend the certificate of public convenience and necessity authorizing the construction and operation of the Yuma Lateral Pipeline Project (Yuma Lateral) issued to NBP, subject to conditions, on September 2, 2008 (Order). Specifically, NBP seeks authorization to revise the initial recourse rates applicable to service on the Yuma Lateral to reflect a representative level of costs attributable to interruptible transportation service on the Yuma Lateral, in compliance with conditions contained in the Commission’s Order.
