SUMMARY: The Federal Aviation Administration (FAA) proposes to fund, construct, and operate an Airport Surveillance Radar, Model 9 (ASR–9) to serve the western airspace of O’Hare International Airport (ORD), Chicago, IL. The FAA’s preferred alternative is to install the ASR–9 at a site near the corner of Kress and Western Roads on the southeast side of DuPage Airport, in western DuPage County. The purpose and need of the ASR–9 is to enhance air traffic management for ORD to achieve the benefits of providing expanded radar coverage that would allow terminal air traffic control for additional new approach routes, as evaluated and approved in the O’Hare Modernization Environmental Impact Statement/ Record of Decision. The FAA has prepared a Draft Environmental Assessment (EA) document in conformance with requirements of the National Environmental Policy Act (NEPA) and FAA Order 1050.1E, Environmental Impacts: Policies and Procedures. The Draft EA analyzes the potential environmental effects that may result from the construction and operation of the ASR–9. The impacts of the radar are evaluated at the proposed Kress and Western site and alternative sites, including the no action alternative (i.e., not installing the ASR–9). ACTION: Invitation for public comments on a requested administrative waiver of the Coastwise Trade Laws for the vessel POLLOCK XIII. SUMMARY: As authorized by 46 U.S.C. 12121, the Secretary of Transportation, as represented by the Maritime Administration (MARAD), is authorized to grant waivers of the U.S.-build requirement of the coastwise laws under certain circumstances. A request for such a waiver has been received by MARAD. The vessel, and a brief PO 00000 Frm 00093 Fmt 4703 Sfmt 4703 6433 description of the proposed service, is listed below. The complete application is given in DOT docket MARAD–2010– 0011 at https://www.regulations.gov. Interested parties may comment on the effect this action may have on U.S. vessel builders or businesses in the U.S. that use U.S.-flag vessels. If MARAD determines, in accordance with 46 U.S.C. 12121 and MARAD’s regulations at 46 CFR Part 388 (68 FR 23084; April 30, 2003), that the issuance of the waiver will have an unduly adverse effect on a U.S.-vessel builder or a business that uses U.S.-flag vessels in that business, a waiver will not be granted. Comments should refer to the docket number of this notice and the vessel name in order for MARAD to properly consider the comments. Comments should also state the commenter’s interest in the waiver application, and address the waiver criteria given in § 388.4 of MARAD’s regulations at 46 CFR Part 388.
